Actual Fraud: Intentional and successful employment of cunning, deception, or artifice to circumvent, cheat, or deceive another. 23 Am J1st Fraud § 4.

Actual Fraud characterized by an evil intent to take undue advantage of another person for the purpose of actually and knowingly defrauding him. Flood v Templeton, 152 Cal 148, 92 P 78.

Constructive Fraud: In its generic sense, “constructive fraud” comprises all acts, omissions, and concealments involving a breach of legal or eqitable duty, trust, or confidence which result in damage to another. Constructive fraud exists in case in which conduct, although not actually fraudulent, ought to be so treated –that is, in which such conduct is a constructive or quasi fraud which has all the actual consequences and legal effects of actual fraud. Re Arbuckle’s Estate, 98 Cal App 2d 562, 220 P2d 950, 23 ALR2d 372.

Falsi Crimen: An offense characterized by fraud through concealment, untruthflness, false weights (and measures), forgery etc. An offense involving untruthfullness so glaring as to affect the administration of jurtice injuriouly. 58 Am J1st Witn § 138.

Fraud: Deceit, deception, artifice, or trickery operating prejudicially on the rights of another, and so intended, by inducing him to part with property or surrender some legal right. 23 Am J2d Fraud § 2. Anything calculated to deceive another to his prejudice and accomplishing the purpose, whether it be an act, a word, silence, the suppression of the truth, or other device contrary to the plain Rules of Common Honesty. 23 Am J2d Fraud § 2. An affirmation of a fact rather than a promise or statement of intent to do something in the future. Miller v Sutliff, 241, Ill 521, 89 NE 651.

It is an Axiom of Law that FRAUD vitiates the most solemn promise to pay.
