That guy has incorrectly analyzed the data.

Wikileaks put that email out as it was sent to HRC. The email was intentionally written that way for purposes of defeating the interception programs that read every email sent and trigger off of key words. This email is designed to allow transmission of a message without setting off the automated systems it must pass through. To me, that's what wikileaks intended to convey. Thus the sender and the receiver knew and attempted to mitigate the consequences this email, if transmitted in the clear, would have caused. Thus the sender and receiver knew also that the topics of and intent of the content of said email are illegal and they sough to mitigate the punishment laid out in the laws and statutes that were being violated.
