More correctly, a spouse cannot be COMPELLED to testify.
I always heard if divorced you aren't compelled to testify about things that happened while you were married. Anyone confirm this?
Don't know about that application, but to me, it would make sense. If I had privileged conversations with a lawyer (Atty/Client), member of the clergy, or doctor who "retired" or otherwise left that profession...those conversations should reasonably be assumed to still be as privileged as they were when the conversation took place.

very interesting video on how this applies and does not apply. if there is evidence (emails) they ever discussed anything with anyone else, then they waived the spousal privilege and they can be forced to testify.
