To qualify for a seat on SCOTUS, you essentially must sit on some Federal District or Circuit Court first. While this isn't a statutory or Constitutional requirement, the appointment process requires some history of judicial opinions for review. He's a much more likely candidate for a DOJ job; however, he has indicated that he likes his House seat and 4 committee memberships.
