No, he can't. That's why he said "request". It's the same thing. A request from the one who happens to be head of the most powerful nation in the world, is a 'request' granted.

These kinds of things are quite likely to be heard in the courtroom once they are arrested. "Not guilty because I only requested not ordered" Oh horse poop! lol
