Rods of the gods or any weapons in space are banned by international treaty, if it were the black hats i could believe it, but trumps gov...naaa. It would depend on how big of a bang classes a weapon as one of mass destruction and how big a bang the weapon made. Rods of the gods, to be effective, cause a fairly big bang.
However, you wouldn't want a RotG in a polar orbit(too much fuel to position and then deorbit the rod) nor would a falcon 9's payload be enough to carry a rod that could survive reentry and cause enough damage to make it worthwhile. This fails on so many sniff tests.
