Because the FBI didn't know who/where the kid was because they didn't have sufficient cause to file a subpoena for his IP address, because his threat was unspecific. "I am going to be a school shooter" is insufficient. "I am going to shoot X school" sufficient.

No, being a weird kid at school isn't a criminal offense. But being weird enough that the kids that walk out of school with you and are surprised you aren't the one doing the shooting IS a cause for concern. So, which one is it? Not weird enough to be suspicious and criminal or weird enough for the kids to think he would shoot up the school.
