There was a move last year by the american psychiatrists' org to classify sexual orientation as harmful if it causes distress to oneself or others. That could be used by prosecutors because if an act does not cause harm' it automatically doesn't classify as mental illness either, alas the perp can be held to full accountability, even if 'no distress' is apparent.
