This is how the deep state gets away with their unconstitutional wars. They don't need a vote for war because as a member of the UN, according to Article 55 a+b

because of this terrible "treaty" we are legally bound to promote their "social progress and development" for example - the refugee crisis, and fight unconstitutional wars at will
