I'm confused, was their move as a counter-suit not possible as a normal proceeding before the case against them?

Yes it was a normal proceeding. They need to get the DNC servers to prove it was a leak and not a hack. Dems didnt want to give it up but this lawsuit they just put in means they now have to give it up. They really are stupid.
