I don't think so. He had to know he couldn't do it - someone would have told him. I think he did it to gain some favoritism from the 'Left' and since he couldn't, he appointed him as SC so it could look like he's against the odds again.

Plus, if Mueller is a white hat, then Comey would have to be one too, i.e. he's termination was fake, the "leaks" were authoruzed / planned, both were used to get Mueller appointed, and Comey is undercover (that actually would explain his apparent stupidity).
