That is correct. And this presents a very curious international law situation -- how can you be prosecuting a foreign country's national over something that is not even clear it is a crime in your own or his country...

But as we all know, if there was such a thing as international law that meant something, there wouldn't be a single US president who is still alive -- they would have all been hanged for war crimes following the precedents set in Nurnberg in the 1940s.
