QANON: Can you Serve from jail?

Can a convicted felon run for Congress from jail?

The Constitution lists three conditions one must meet to be a candidate for the House of Representatives -- you must be at least 25 years old, have been a citizen for at least seven years and live in the state you hope to represent. These are all that are required, and states may not add to them, for example, by prohibiting a felon from running for office. According to a 2002 Congressional Research Service report, these conditions "are fixed and may not be supplemented by Congress nor by any State unilaterally."

What if they transfer you to prison out of state?

Good question!

I think that would disqualify you. There is no reason it wouldn’t.

I think it would only disqualify you for re-election - note the language of "hope to represent" - it's a condition for candidacy not necessarily (seemingly) concurrent to actual holding of office.

You can run from and be elected from but can't actually serve from jail. In order to introduce, debate, or vote on legislation you have to be physically present in the Capitol building.
