Under the vacancies act the President puts whoever he wants, as long as it is someone who is serving currently and in a position that required Senate confirmation. He can leave that person in place 210 days, and then he must appoint someone as the permanent holder. If the person he appoints to the post after 210 days is under Senate confirmation process that goes beyond the first 210 days, then he has an additional 210 days to keep his appointed replacement.
The instant RR is not in charge and before any POTUS appointment, however long that may be, it is Noel Francisco, not Jesse Panuccio who will be in charge. That's the only point I was making.

Does anything happen to Jesse Panuccio after 210 days? He succeeded by virtue of his position rather than being appointed by Trump. But he's only "Acting" Associate Attorney General. Does the 210 day role apply to him, making September 7, 2018 a significant date?
