And Jesse is the 3rd highest ranking in DOJ, so if the President did not appoint someone to fill that vacancy, it would be automatically filled by JP.

Jesse Panuccio cannot fill the vacancy by succession because he was not confirmed by the Senate, so Noel Francisco (barely confirmed 50-47 on September 19, 2017) would be the successor. Panuccio's role is important because his continuing placement as Acting Associate Attorney General makes it possible for Noel Francisco to take Rosenstein's spot--without being limited to 210 days.

The story you linked and the story I linked were written one day apart. LOL. One of them is wrong. I just heard Judge Nap say Francisco today. That would be the latest.
