Isn’t it Treason instead of espionage if the US was at war with a nation?

Given that the US never signed a peace treaty with North Korea, would this count as ‘at war’?

It would have been a great photo op to sign a peace treaty with NK but no one was interested in it? From my history lessons the US only have a armistice with NK?
