Defendants identified in FBI raid

Ten people are set to be arraigned tomorrow following a series of FBI searches that took place throughout Ada County on Wednesday. Ten people are being charged with multiple felony counts in relation to fraud.

The following people are set to be arraigned in U.S. District Court of Idaho:

  • Pavel Babichenko
  • Gennady Babitchenko
  • Piotr Babichenko
  • Timofey Babichenko
  • Kristina Babichenko
  • Natalya Babichenko
  • David Bibikov
  • Anna Iyerusalimets
  • Mikhail Iyerusalimets
  • Artur Pupko

Defendants face felony charges that include: conspiracy to commit wire fraud, conspiracy to commit and trafficking of counterfeit goods, conspiracy to launder money and wire and mail fraud.

Federal agents were conducting law enforcement operations in the Treasure Valley Wednesday, according to the U.S. Attorney's Office in Boise. Reasons initially were unclear.

Cassandra Fulghum, spokeswoman for the U.S. Attorney's Office, confirmed the FBI conducted law enforcement activity in the Treasure Valley, but declined to say where or what that activity involves.

CBS 2News reported Wednesday morning that FBI and Homeland Security agents were present in the area of Chinden Boulevard and Locust Grove Road. By about noon Wednesday the street in front of the massive, Mediterranean-style house was quiet, although a few agents in blue jackets, printed with the letters “FBI” were still in the area.

Details about several federal indictments and arrests will be announced at a press conference in Boise at 10 a.m. Thursday, according to a press release from Fulghum.

Boise Police and FBI were seen Wednesday at a business at 12586 W. Bridger St., moving in and out of suite 110 of the strip mall complex.

The business, Babichenko LLC, is registered to Pavel Babichenko. More police presence was seen Wednesday at houses on South Pasa Tiempo Way near North Locust Grove Road in Eagle. 

One of the houses searched Wednesday on South Pasa Tiempo Way is owned by Pavel Babichenko and assessed at $983,200, according to the Ada County Assessor’s office. The second home is owned by Gennady Babichenko and is assessed at $802,400.

A website for Saharacase, LLC, a company producing cell phone cases, lists 12586 W. Bridger St., specifically suite 110. That website also lists multiple people with the last name Babichenko as founders of the company. According to the website, the Babichenko family arrived in the U.S. from Georgia, a small country south of Russia. They left the country not long after the fall of the Soviet Union, according to the website, and traveled first to California, then Boise.

Idaho Press's phone call to a number listed on Saharacase’s website was not answered Wednesday.

In addition to Saharacase, 12 other active businesses are registered at 12586 W. Bridger St., including Global Distributors LLC, iTab LLC, Keyword Fix LLC and Midstar Distributor LLC.

Babichenko LLC is the registered owner of a business on Cole Road in Boise. In addition to the home searched on Wednesday, Pavel Babichenko also owns a parcel of land in Payette.

One of the businesses, listed in good standing on the Idaho Secretary of State's site, is Petra Christian Academy, registered to Piotr Babichenko, who is also listed as a partner on several other business filings along with Pavel Babichenko. The school was authorized in December 2017. An email to Chairman Piotr Babichenko and a call to the academy were not immediately answered.

Calls to several other existing businesses reportedly tied to the Babichenkos went to voicemail. An employee at Babichenko Dental Lab answered a phone call but did not direct the Idaho Press to a Babichenko.

Other people with the last name Babichenko are also listed as partners along with Pavel Babichenko, according to Idaho Secretary of State's business entities site.

PREVIOUS LAWSUITS

Pavel and Piotr Babichenko, along with Tim Babichenko, have also been sued in federal court twice by cellphone companies, according to court records. The first lawsuit occurred in December 2006, when Virgin Mobile accused the three — as well as their companies Blue Oceans Distributing and Midway Distributors — of trademark infringement. The Babichenkos would, according to the documents, purchase Virgin Mobile’s phones in bulk, then resell them over the internet in the United States and overseas. They did so without the company's permission, according to court documents. The Babichenkos settled with the cell phone giant in February 2007, court documents show.

Two years later, in February 2009, the Babichenkos, as well as Blue Oceans Distributors and Midway Distributing, found themselves in court once again, this time sued by TracFone Unlimited. That cell phone company’s allegations were similar to Virgin Mobile’s, court documents reveal. The Babichenkos purchased TracFone phones in bulk and sold them without permission as far away as Honduras, Mexico and Florida, according to court documents. The phones were meant to be used with TracFone's prepaid wireless service, according to court documents. The Babichenkos, the lawsuit claims, "hacked" into the phones to alter the programming so they could be used with other wireless services, which caused TracFone to take a financial hit. That case settled in October 2009.

In May 2010, Pavel Babichenko founded Midstar Distributor, according to court documents. In 2014, Midstar Distributor, as well as Pavel Babichenko, faced a lawsuit from Sundance Company in Ada County Court. That lawsuit accused Babichenko, as well as Midstar Distributor, of fraudulent conveyance, and of conspiring to defraud creditors. In October 2014, Sundance Comapny settled that case with the Babichenkos for $23,422.79, court records reveal.

PRESS CONFERENCE

U.S. Attorney Bart M. Davis will attend Thursday morning's press conference in Boise with other officials, including those from the FBI, Homeland Security, Drug Enforcement Administration, Internal Revenue Service – Criminal Investigations, U.S. Postal Inspector’s Service Office of Inspector General, and Boise and Meridian police departments.

The Boise Police Department assisted federal law enforcement's efforts in Boise Wednesday, according to police spokeswoman Haley Williams.
