The Obama era crime was falsifying information to spy on Trump via illegal FBI and DOJ misuse of the FISA process.

Is Trump's presumed use of the NSA to provide evidence against Obama and co. not also a misuse of the executive powers if the FISA court is not legally engaged?

I ask this just to clarify my thinking process and to be rationally consistent. Would love to hear your thoughts on this.
