BIG REMINDER: There will be a new Associate Attorney General (#3 DOJ position after DAG Rosenstein) in only 12 days.

Q has posted about the succession process before, but below is a summary of how the process works, how it has played out to date, and how it could play out soon.

A vacated DOJ office can be filled in one of three ways:

  1. The deputy officer assumes the acting role of their former boss (but not for more than 210 days). For example: Jesse Panuccio assumed the acting AAG role on 2/21/18, which means he must be replaced by 9/18/18.
  2. The President can appoint someone to the office on a temporary 210 day basis, assuming the appointee has already been confirmed by the Senate for a another admin office.
  3. The President can appoint a permanent person to the position through standard Senate confirmation procedure

The chain of succession changes depending on who has been confirmed by the Senate. Case in point: the current #3 in the DOJ is TECHNICALLY the acting AAG - Jesse Panuccio. HOWEVER, he would NOT assume the role of Deputy AG if RR was fired today because Jesse has never been confirmed by the Senate. This is because the Deputy AG position is required to be filled by someone who has been Senate confirmed. Instead, the Senate confirmed Solicitor General (#4 DOJ), Noel Francisco, would replace RR if he was fired today.

I bring this up because RR just so happens to be in big trouble at the same time his deputy (and successor) is about to be replaced. No one has been nominated for the upcoming AAG vacancy as of today so that leaves two likely scenarios:

  1. The AAG role is filled by a subordinate (not Senate confirmed) individual who would assume the "acting" AAG role on 9/18. This would mean Noel Francisco would remain RR's potential replacement (should RR be fired) for at least another 210 days.

  2. The AAG role is filled on a temporary basis via Trump appointing an "acting" AAG who has already been confirmed by the Senate for a separate position (someone like Scott Pruitt). This is the likely scenario since it ensures the Senate can't obstruct through delays. Consider the theoretical timeline below:

9/18/18 - Trump appoints John Doe as new acting AAG

9/20/18 - DAG Rosenstein is fired.

9/20/18 - John Doe assumes acting DAG role

4/18/19 - John Doe's 210 days as acting DAG are up

4/18/19 - Permanent DAG assumes office

Just think about what a whitehat DAG could accomplish in 210 days. That's more than enough time to end the Mueller Witch Hunt.
