Quick question: WHAT WOULD KEEP THE DEMS FROM SIMPLY WITHDRAWING THE LAWSUIT???

I thought "legally" you could do that??? The only thing I can think of to get around it is IF a COUNTER-SUIT WAS FILED RIGHT AWAY?????
