EPA Forced To Ban Pesticides Based On ‘Secret Science’ It Wants To End

 

The Environmental Protection Agency (EPA) has fewer than 60 days to ban a commonly-used pesticide after a federal court ruled in favor of environmental activists in early August.

 

The Natural Resources Defense council (NRDC) celebrated the Ninth Circuit Court of Appeals ruling, arguing that EPA’s decision not to ban chlorpyrifos ignored “solid science” from its “own scientists” that the pesticide “harms the developing brain” of children. The court reversed the Trump administration’s decision not to ban chlorpyrifos, a widely-used pesticide in agriculture.

 

However, EPA’s “own scientists” did not rely on their own research, but instead relied on research done outside the agency to propose banning chlorpyrifos late in the Obama administration. NRDC and other activist groups petitioned EPA to ban chlorpyrifos in 2007.

 

In fact, EPA relied on a single study by the Center for Children’s Environmental Health at Columbia University that examined chlorpyrifos levels in umbilical cords. The study’s underlying data is not publicly available, reigniting the debate over EPA’s use of “secret science” in regulations.

 

“Yet this proposed ban was not based on actual EPA research; it was based on a single, privately-produced study for which data remains unavailable to the public — even the EPA staff have never been able access to the underlying data,” wrote Angela Logomasini, a senior fellow at the free market Competitive Enterprise Institute.

 

EPA proposed a rule in April requiring federal officials to make public underlying data of studies used to justify costly regulations. Republicans have been pushing for science transparency rules for years, citing the agency’s attempt to ban chlorpyrifos as a reason why.

 

“If anything, this situation underscores the need for greater transparency of regulatory science rather than the need for EPA to blindly regulate away useful products,” Logomasini wrote in a blog post on the court’s decision.

 

Democrats and environmentalists oppose transparency in EPA science, arguing it could expose personal health information that’s protected by law and would be used to undercut regulations. (RELATED: An Obama-Appointed Judge Handed Enviros A Win On Keystone XL Pipeline)

 

Thursday was the last day for outside parties to submit comments to EPA about its transparency plan. So far, EPA received more than 246,000 comments regarding the rule, according to Regulations.gov.

 

As it stands, EPA’s transparency rule does make exceptions for personal information, and it’s still unclear how exactly the agency plans on disseminating data. Still, environmentalists oppose requiring data used to craft regulations be made available to the public.

 

News outlets, like The New York Times, former EPA officials, many public health experts and science organizations also opposed the transparency rule.

 

“Over the years, such studies have been crucial to establishing links between mortality and pollution, led to regulations and saved many lives,” The New York Times editorial board wrote in April. “Limiting policymakers to only those studies with publicly available health data greatly narrows the field of research.”

 

However, EPA’s using of a single study with non-public data illustrates the problems of rule making with so-called “secret science.” Even EPA’s Science Advisory Panel was critical of the use of a single study to ban a class of pesticides.

 

“The majority of the Panel did not agree with the Agency’s use of the results from a single longitudinal study to make a decision based on the use of cord blood measures of chlorpyrifos as a PoD for risk assessment,” according to proceedings of a March 2016 SAP meeting.

 

“The majority of the Panel stated that using cord blood chlorpyrifos concentrations for derivation of the PoD could not be justified by any sound scientific evaluation,” reads the meeting document.

 

The SAP also said a major source of concern “was the lack of verification and replication of the analytical chemistry results that reported very low levels of chlorpyrifos.” Logomasini put it more simpler terms.

 

“That is, EPA staff basically made data up to fit the predetermined conclusions of the Center for Children’s Environmental Health study,” she wrote. “That’s pretty outrageous and certainly not how scientific research should be performed. In fact, this approach fits the definition of junk science.”

'A Solid Dozen' More of the 'Most Damning' Planned Parenthood Body Parts Videos May Be Forthcoming

 

On Wednesday, David Daleiden and his lawyers filed a motion to dismiss a gag order in the federal case involving the undercover sting videos showing Planned Parenthood selling baby body parts for profit. If the federal judge's gag order is dropped, Daleiden told reporters that at least 12 new videos would drop.

 

In a conference call with reporters, Daleiden, project lead at the Center for Medical Progress (CMP), said that if the gag order is lifted, "You can expect probably a solid dozen more videos, really in the same vein as the original undercover video releases" in 2015. He was responding to a question from the Washington Free Beacon's Bill McMorris.

 

Daleiden and CMP became famous (or infamous) for publishing videos showing Planned Parenthood affiliates haggling over prices for aborted baby body parts in 2015. Planned Parenthood responded by hiring Fusion GPS to publish a report suggesting the videos were falsely edited. Then, the National Abortion Federation (NAF) brought a federal lawsuit against Daleiden. As part of that lawsuit, a federal judge placed an injunction on further videos, which Daleiden said were some of the "most damning."

 

"NAF's federal lawsuit was one of the first in federal court sought a federal gag order against the remaining undercover videos," Daleiden told reporters on the call. "This undercover footage has not seen the light of day. It includes some of the most damning and incriminating tapes that we ever recorded" about "the sale of aborted baby parts."

 

NAF dropped seven of the original eleven claims against Daleiden and CMP in July, and Daleiden's lawyers filed three orders on Wednesday: an anti-SLAPP motion to strike NAF's complaint, a motion to dismiss NAF's complaint, and a motion to dissolve or modify and clarify the preliminary injunction on the videos.

 

Since the NAF federal lawsuit no longer includes the federal claims, Daleiden's lawyers argued that it should be struck out of federal court.

 

Furthermore, recent events have underscored the truth behind the sting videos. Last December, DaVinci Biosciences and DV Biologics admitted guilt in a $7.8 million settlement with the Orange County District Attorney for selling aborted baby body parts from Planned Parenthood of Orange & San Bernardino Counties for profit. Planned Parenthood affiliates are also under criminal investigation by the U.S. Department of Justice.

 

"The DaVinci companies’ admission of guilt for selling baby parts from Planned Parenthood is a ringing vindication of CMP’s citizen journalism methods and accuracy," Daleiden declared in a release about the DaVinci companies settlement.

Even if the orders filed Wednesday are honored, however, new Planned Parenthood sting videos would not come out until October, Daleiden said.

 

The videos covered in the gag order involve meetings of the NAF at its annual convention. Daleiden insisted that the videos were filmed in public places. Daleiden and his lawyers also remarked on the unprecedented nature of a California prosecution case brought against CMP staff. For the first time in California history, the state is prosecuting a journalist for filming undercover videos.

 

Importantly, the videos covered by the gag order are now key evidence in the criminal case, and Daleiden's lawyers warned that "any restriction on them from the federal court would unconstitutionally interfere with the California justice system and David Daleiden's 1st, 4th, 5th, 6th, 8th, and 14th amendment rights to defend himself from the AG's and Planned Parenthood's false charges."

The new documents include material classified “confidential” on negotiations between Northern Ireland and UK, as well as negotiations with Israel, Palestine, and France. They also include a reference to a Clinton meeting with controversial leftwing billionaire George Soros, and advice to Clinton from Sid Blumenthal, who was barred from a State Department position by the Obama administration and regardless continued to advise her on matters of state.

 

On June 7, 2011, Clinton received classified information on her non-secure email account from former British Prime Minister Tony Blair, which Blair also forwarded to Jake Sullivan, about Blair’s Middle East negotiations with Israel, the Palestinians and the French

On January 26, 2010, Clinton’s Deputy Chief of Staff Jake Sullivan sent classified information via his unsecure Blackberry to Huma Abedin’s State Department email account that he’d earlier sent to Clinton’s and Abedin’s non-secure @clintonemail.com email accounts about U.K. negotiations with Northern Ireland.

On October 28, 2010, Clinton exchanges information with her friend Marty Torrey – a congressional aide – who asks Clinton in an email if she would advise that Torrey meet with former Pakistani President Pervez Musharraf. Clinton responds through her non-secure email account approving the meeting and notes that she is emailing him from Hanoi, Vietnam.

An email chain dated April 8, 2010, which contains a memo from Sid Blumenthal to Hillary Clinton related to the change of government in Kyrgyzstan, contains information classified “confidential” and is redacted as “foreign government information” and “foreign relations or foreign activities of the United States, including confidential sources.” Blumenthal urges Clinton to “develop relations” with the new government in Kyrgyzstan.

 

All of this suggests to me the necessity for the State Department to assert itself and take the lead in developing relations with the new government.

 

Abedin emails Clinton about “Invites for the week” in an undated email (but apparently written before November 1, 2011, the day Clinton’s mother died, because her mother is one of the invitees – probably written in early 2009, based on the period most of these emails seem to have been written), and notes that she (Clinton) has a “George Soros lunch from 1-3 in Southampton.”

On October 20, 2010, lawyer Lanny Davis writes Clinton an email saying, “Thank you H for who you are and what you do,” followed in the exchange by another with “PS. I swear you look younger and better every time I see you, Good night dear Hillary. Lanny.” Mr. Davis is currently a lawyer for Michael Cohen.

In an undated email, Blumenthal emails Clinton about State Department management issues suggests that Joseph C. Wilson “should be spoken with for his view of dept, personnel … is shrewd.” Wilson is a former ambassador to Gabon who went on to become an Africa consultant and deal-maker.
