POTUS can invoke emergency powers in extraordinary circumstances. At some point, because of balance of powers, he would need to let Congress know. It would be up to his own discretion. Congress could impeach him if really upset about it. But otherwise, he can do anything he wants to protect the country. It is his most sacred duty.
