Judge rules Seattle media companies must hand over unpublished protest images to police

Five news outlets, including The Seattle Times, will have to comply with a subpoena and give the Seattle Police Department unpublished video and photos from a May 30 racial justice protest that turned violent, a judge ruled Thursday. King County Superior Court Judge Nelson Lee sided with the Police Department in a morning hearing, ruling that its subpoena was enforceable. He found that the photos and video were critical for an investigation into the alleged arson of SPD vehicles and theft of police guns.

 

Lee said the news organizations were not protected by a Washington state shield law that under many circumstances prevents authorities from obtaining reporters’ unpublished materials.

 

The judge placed some limits on the subpoena. He said police could use the images to identify suspects only in the arson and gun theft investigations. Detectives could not use the photos or video to pursue suspects in vandalism or other lesser crimes — even if police found such evidence. The subpoena would also be limited to professional camera equipment and would exclude reporters’ cell phone photos and videos. The Seattle Times and TV stations KIRO 7, KING 5, KOMO 4 and KCPQ 13 were all subpoenaed.

 

Lee ruled that the SPD had met its burden to overcome the shield law: that the images were “highly material and relevant” and “critical or necessary” to prove an issue that has a compelling public interest for its disclosure. Getting the stolen weapons off the street was one compelling public interest, Lee found. The law also required the police to demonstrate that all “reasonable and available means” to obtain the information has been exhausted.

 

Seattle Times Executive Editor Michele Matassa Flores said the paper strongly opposes the subpoena and “believes it puts our independence, and even our staff’s physical safety, at risk.” “The media exist in large part to hold governments, including law enforcement agencies, accountable to the public,” said Matassa Flores. “We don’t work in concert with government, and it’s important to our credibility and effectiveness to retain our independence from those we cover.”

 

The lawyer representing the media companies, Eric Stahl, argued Thursday that the police were casting too wide a net and couldn’t show that the images would identify the suspects. “You have to have a strong reason to believe there is actually going to be critical evidence” in the images, Stahl said after the hearing. “We think there was too much speculation going on.”

 

The media companies have not yet decided if they will appeal the case, Stahl said. In a statement, the ACLU of Washington said the ruling “threatens the independence of the media. A free and independent media is a cornerstone of our democracy, and at a time when our basic freedoms are under attack, the City of Seattle should be doing everything possible to protect those foundational freedoms.” Brian Esler, a Seattle attorney hired to represent the Seattle police, did not respond to an interview request.

During the protests, vandals heavily damaged six police vehicles. They smashed windows, removed ballistic helmets, uniforms, emergency medical equipment and fire extinguishers, and used an accelerant to start fires in five vehicles, according to a police affidavit and other documents. A loaded Glock 43 semi-automatic pistol and a loaded Colt M4 carbine rifle with a suppressor remain missing, according to the SPD affidavit.

 

The SPD subpoena seeks media images taken during a 90-minute span in a four-block area between Fourth and Sixth Avenue and Olive Way to Pike Street that day. Lee set a hearing for July 30 at 9 a.m. to enter a final order. In the meantime, the parties are discussing how long it would take to produce the unpublished materials.

Media Downplays Ongoing Violence In Portland, Claims ‘Right-Wing’ Outlets Are Playing Up The Unrest

 

PORTLAND, Ore. — The Mark O. Hatfield Courthouse and federal officers continue to be targeted night after night in Portland, but some in the media are downplaying the violence.

 

Protests and riots in Portland are nearing 60 consecutive days. During that time, the courthouse and officers guarding it have repeatedly been subjected to violent acts by rioters, as Daily Caller reporters on the ground have reported. Despite this, many in the media have downplayed the violence, with CNN’s Brian Stelter claiming that it’s simply the “right-wing media” playing “up Portland protest ‘violence.'”

 

“Right-wing media ramped up its coverage of scattered unrest in Portland, Oregon last week at roughly the same time that federal officers descended on the downtown area,” Stelter wrote on July 20. ” [Fox News’ Sean] Hannity and other Fox hosts evidently decided that a small group of self-described anarchists suddenly deserved national news coverage.”

 

Stelter continued on to point to “local reporters” who appeared to tell the network that the blame for escalating violence was due to federal officers being deployed to guard the courthouse.

 

“Some local reporters, who have been hard at work covering Portland demonstrations since they first began, tell us there was a noticeable shift in protests after Trump sent in the Feds,” CNN correspondent Josh Campbell tweeted. “Protestors want the federal cavalry out now.”

 

Local reporters have not been the only ones downplaying the nightly violence. The Oregonian pushed back on claims of violence with a July 18 article titled: “Feds, right-wing media paint Portland as ‘city under siege.’ A tour of town shows otherwise.”

 

“And they occur exclusively during late-night hours in which only a couple hundred or fewer protesters and scores of police officers are out in the city’s coronavirus-hollowed downtown,” according to the newspaper, which described the violence as coming from “a small number” of “20- and 30-something demonstrators.”

 

Those events are hardly representative of daily life, including peaceful anti-racism demonstrations that have drawn tens of thousands of protesters, in a city of 650,000 people that encompasses 145 square miles. The vast majority of Portland residents spend quiet home-bound lives on hushed tree-lined streets with coronavirus and its resulting economic catastrophe as the greatest threat to their well-being.

 

While the violence is typically reserved for evening hours, the consistent barrage of attacks and methods used by rioters against the courthouse and officers is part of the story. It also seems that some in the media would be more comfortable dismissing the hours of violence each night.

 

Reporters on the ground have witnessed repeated attempts by large crowds to tear down fencing in front of the courthouse. Fires are often lit and firecrackers are launched at the courthouse and near officers standing guard. The crowd has been able to tear down the fence successfully on more than one occasion, and some shine lasers and lights into the eyes of federal officers.

Officers often respond to escalations with tear gas, pepper bullets and other crowd control munitions. As the riots have continued, the crowd has become more aggressive and driven, often bringing shields and umbrellas that result in standoffs with officers.

 

Print newspapers such as the New York Times also pointed to “right-wing outlets” as seizing on the protests to push a narrative.

 

“Right-wing outlets and conservative media stars have seized on the weekslong protests in Portland as a rallying cry for law and order, instructing their followers to fear for their safety and blaming Democratic leaders for failing to restore peace,” the Times wrote on July 22.

 

“The nuances of the Portland protests — which reflect a diverse mix of grievances, including civil rights, anti-fascist causes and frustration with the president — have not been noted by the conservative media world,” the article continued. “Instead, in an echo of Mr. Trump’s portrayal, right-wing media has presented the situation as an urban nightmare. Far from recoiling at big-government interference, conservative hosts have loudly applauded the Trump administration for superseding city and state authorities.”

Seattle mask report:

I don't wear a mask - only time was a mandatory lab test in clinic. 5 mins.

Today, no problem at Freddys or Lowe's. Came in thru the garden center in both cases.

I currently use snagit to generate mp4s.

but often, i take them off yt

and cannot reduce the size of the video area to, say 2-4 inches (which would be sufficient for showing MDs talking about HCQ or whatever). That would make a much smaller file size.

 

bc my biggest problem right now is making a record of stuff that's way too big for 8kun 16meg limit). Current use qrbunker on endchan for files up to about 70 megs; after that, files won't be uploaded (even tho endchan claims a limit of 350 - no way).

 

Am looking at anonfiles.com for storing vids up to 500mgs, have not used so far.

 

Need to knw alot more about how to CONDENSE large vids. I've looked at various programs but the language they use is not for beginners. Video has so many parameters. I can use the 'default' but often it usually does not condense enough. I've seen anons condense much more than i'm capable of and get very good results.

–This memorandum serves to a) revise the maximum limits of individuals participating in

gatherings, b) prohibit live entertainment in Phases 1 through 3 and all modified phases of the

Safe Start Plan, and c) adjust various other provisions of the Safe Start Plan.–

 

Gatherings

Effective July 20, 2020, gatherings are not to exceed ten (10) individuals in Phase 3. The

existing limitation of five (5) individuals in Modified Phase 1 and Phase 2 is unchanged. For

purposes of this memorandum and Washington’s Safe Start Plan, the definition of “gatherings” is

likewise unchanged.

The limitations on gatherings do not apply to religious practices, weddings, funerals, business

activities, or any other activity covered separately by a Governor-issued memorandum or safety

plan.

For any Governor-issued order that expressly refers to the gathering limitations, the new Phase 3

limitation on gatherings will govern.

 

Live Entertainment

Effective July 20, 2020, '''all live entertainment is prohibited except performances outdoors for

members of the same household where social distancing of a minimum of 10 feet is always

maintained from the entertainer and facial coverings are worn by all individuals.'''

g. Indoor service at taverns, breweries, wineries, and distilleries is prohibited.

h. If a brewery or winery also has a restaurant license, it may continue restaurant

operations pursuant to the safety requirements for dine-in restaurants and taverns.

i. If a temporary structure is erected to provide outdoor service, the structure cannot

be enclosed by more than two walls. The limitation on walls applies to both rigid

and flexible walls.

  1. Family Entertainment and Recreational Centers

Indoor family entertainment and recreational centers, including miniature golf, putt putt,

bowling alleys, indoor go-karts, arcades, and substantially similar activities, are

prohibited.

  1. Card Rooms

Indoor card rooms are prohibited.

  1. Movie Theaters

Indoor movie theaters are prohibited until Phase 3. In Phase 3, indoor movie theaters are

limited to a capacity of 25 percent.

 

EffectiveAugust 10, 2020, the following changes to the Governor’s Memorandum on Phase 1,

2, and 3 Religious Weddings and Funerals will apply in all phases regardless of venue:

a. Indoor occupancy is limited to 20 percent or 30 people, whichever is less, if and

only if six feet of physical distancing between households can be achieved.

Outdoor ceremonies are limited to 30 people, and at least six feet of physical

distancing between households is required.

Portland preps for potentially violent protests

 

Portland had Antifa protests August 16, 2019 in the area of the Federal Courthouse. POTUS tweeted about it on August 17, 2019. What a difference a year makes in local government reaction.

Antifa agitators have filed a lawsuit against the City of Seattle, claiming that a heavy handed police response to “protests” has forced the group to invest in more expensive riot gear.

 

KIRO 7 News reports that Antifa is complaining that police use of blast balls, sponge rounds, pepper spray, and other crowd control methods has meant the rioters have had to buy “expensive” protective gear.

 

“Because the Seattle Police Department has acted above and outside the law in dispensing its unbridled force, and the City has failed to prevent same, the government effect is to establish a de facto protest tax,” the lawsuit claims.

 

“Individual protesters subjected to SPD’s unabated and indiscriminate violence now must purchase cost-prohibitive gear to withstand munitions – even when peacefully protesting – as a condition to exercising their right to free speech and peaceable assembly,” lawyers also suggest.

 

“The continued misuse of war munitions by SPD against civilians turns the streets – a public forum and site of protest – into a pay-to-protest racket where only a privileged few who are wealthy enough or popular enough to crowdsource funds to purchase gear akin to that used by the police department they fund can truly be in the streets,” the lawsuit continues.

State and Local Authority Over Vaccination

 

Under the federalist system of the United States, state governments have the general authority, within constitutional limits, to enact laws “to provide for the public health, safety, and morals” of the states’ inhabitants. In contrast to this general police power, as discussed below, Congress’s power to legislate is confined to those powers enumerated in the Constitution.

 

The states’ general police power to promote public health and safety encompasses the authority to require mandatory vaccinations. Pursuant to this authority, states and localities have long enacted various compulsory vaccination laws for certain populations and circumstances, including for school children and certain health care workers and in cases of public health emergency. In the early part of the 20th Century,

 

the Supreme Court twice considered constitutional challenges to such mandatory vaccination requirements. Each time, the Court rejected the challenges and recognized such laws to fall squarely within the states’ police power. In 1905, the Supreme Court in Jacobson v. Commonwealth of Massachusetts upheld a state law that gave municipal boards of health the authority to require the vaccination of persons over the age of 21 against smallpox, determining that the vaccination program had a “real and substantial relation to the protection of the public health and safety.” In doing so, the Court rejected the argument that such a program violated a liberty interest that, under more modern jurisprudence, would likely have been asserted as a substantive due process right.

Less than two decades later, in Zucht v. King, parents of a child who was excluded from school due to her unvaccinated status challenged the local ordinance requiring vaccinations for schoolchildren, arguing that the ordinance violated the Equal Protection and Due Process Clauses of the Fourteenth Amendment. Relying on Jacobson, the Supreme Court rejected the constitutional challenges, concluding that “it is within the police power of a State to provide for compulsory vaccination” and that the ordinance did not bestow “arbitrary power, but only that broad discretion required for the protection of the public health.”

 

All 50 states, as well as the District of Columbia, currently have laws requiring specified vaccines for students. This requirement is generally subject to certain exemptions, which vary from state to state.

 

While all student immunization laws grant exemptions to children for medical reasons (e.g., if a child is allergic to vaccines or immunocompromised), most but not all states grant religious exemptions for those whose beliefs counsel against immunization. Sixteen states also provide a broader philosophical exemption for those who object to immunizations because of personal, moral, or other beliefs.

While compulsory vaccination requirements have faced legal challenges since Jacobsen and Zucht, courts have consistently rejected these challenges and given considerable deference to the use of the states’ police power to require immunizations to protect the public health. A number of relatively recent decisions, for instance, have concluded that a state is not constitutionally required to provide a religious exemption, upholding compulsory vaccination laws that provide only a medical exemption. In states that provide a religious exemption and where parents have filed suit to challenge their unsuccessful invocation of the exemption, courts, applying the relevant state law, have, at times, scrutinized whether their objections to vaccination are based on a sincere religious belief.
