The motion to dismiss can be granted at anytime, even after the jury reaches a verdict.

Hi John - I am not a legal expert. You probably know more than me so I ask. Has the window closed to a mistrial because the case is now to a jury or can a mistrial be declared after the jury rules?

Last week the defense stated orally their intention to file a motion to dismiss with extreme prejudice. They have since did so formally by submitting the written motion to the court.
The court has not yet addressed this motion.
