Alibaba’s Jumbo Bond Deal Goes Quiet With Jack Ma Out of Sight

 

Investors are beginning to question whether Alibaba Group Holding Ltd. can pull off a jumbo dollar bond in coming weeks given the uncertainty around co-founder Jack Ma and the Trump administration’s possible ban on investments in Chinese securities.

 

The potential sale of as much as $8 billion in offshore debt was planned for as early as this week, however a marketing memorandum hasn’t yet been received by prospective investors, according to people familiar with the matter, who asked not to be identified as they’re not authorized to speak publicly. A spokesperson for Alibaba had no immediate comment on the progress of the sale.

 

That silence is leading investors to question whether the e-commerce giant will proceed with a sale at an increasingly challenging time. Reports of a potential U.S. investment ban this week also prompted spreads on some of Alibaba’s dollar notes to hit their widest in six months, Bloomberg-compiled prices show. And with the leadership of President Elect Joe Biden weeks away, there’s a good case to hold off until his China policy becomes clear.

 

“If I were the underwriter I would wait until the Biden Administration gets underway and perhaps take a more considered tone with China,” said Geof Marshall, who runs the fixed-income team at CI Global Asset Management’s Signature Global Asset Management, which has about C$30 billion ($24 billion) under management.

 

A debt sale of this magnitude would have been a show of strength for the company, signaling global investor confidence and reaffirming a key channel of funding for the firm. The global debt offering was set for at least $5 billion, but could have raised as much as $8 billion depending on the reception, Bloomberg reported previously. That would match Alibaba’s record-setting debut in 2014, the largest offshore bond sale by a Chinese issuer.

 

Ma hasn’t been seen in public since his Internet empire was hit with a growing antitrust crackdown and the suspension of affiiliate Ant Group Co.’s $35 billion IPO, while he castigated regulators for focusing too much on risk and stifling innovation. His absence from public view may deter potential investors already worried about the storm that has engulfed one of China’s most powerful corporations.

Mexico could cancel private prison contracts, says president

 

Mexico’s president will seek better terms for the government in private prison contracts signed by his predecessors, he said on Wednesday, adding that he could cancel them if better deals cannot be reached. The private prison contracts were much too expensive and represented the worst of privatization, President Andres Manuel Lopez Obrador said at a regular government news conference.

 

“We need to talk to the providers of these services so that an agreement is reached because we consider (the contracts) to be abusive,” said Lopez Obrador. He said a civil complaint is being drawn up to cancel the contracts if new terms are not reached. Lopez Obrador has previously put pressure on energy and chemical companies over contracts he considers unfair.

 

U.S. asset manager BlackRock Inc is among the investors that have been involved in prisons in Mexico. During the government of Lopez Obrador’s predecessor, President Enrique Pena Nieto, payments for the Ramos Arizpe prison in the northern border state of Coahuila jumped by nearly 18% just before BlackRock purchased it, according to records reviewed by Reuters in 2017. BlackRock at the time declined to comment. The asset manager did not immediately respond to a request for comment for this article.

 

Ex-President Felipe Calderon, who preceded Pena Nieto, launched the partial privatization of Mexican prisons during his 2006-2012 term with eight facilities. Under Calderon’s model, the contractors did not manage security or healthcare at the facilities, but instead secured the land, built the prisons and then provided services like food and laundry over 20-year contracts. Lopez Obrador, who ran and lost against both Calderon and Pena Nieto, routinely criticizes both men on a range of policy disagreements as well as for alleged graft during their terms.

Intel Soars After CEO Bob Swan Announces Resignation

 

Just two weeks after Third Point launched an activist campaign targeting Intel, when on Dec 29, Dan Loeb sent a letter to the chip-challenged semiconductor company urging it "to evaluate strategic alternatives" including "potential divestment of certain failed acquisitions," and in which Loeb said that Intel’s most urgent task was addressing its “human capital management issue”, as many of its talented chip designers have fled, “demoralized by the status quo”, moments ago we got the latest departure of "human capital" when CNBC reported that CEO Bob Swan was stepping down effective February 15, and would be replaced by VMWare CEO Pat Gelsinger .

 

The stock has reacted furiously, surging as much as 14% premarket…

Japan halts business travel and threatens to deport quarantine violators

 

The Japanese government will restrict the entry of all nonresident foreign nationals, halting business travel agreements reached with 11 partners including China and South Korea, in an effort to curb the spread of the coronavirus. The suspension will start as early as Thursday as Japan's state of emergency expands beyond Greater Tokyo. It is expected to last until Feb 7.

 

Prime Minister Yoshihide Suga touched on the tighter border restrictions in a Wednesday evening news conference, referring to new COVID-19 strains found in travelers returning from the U.K. and Brazil. "Citizens are increasingly anxious, and I am taking the situation seriously," he said.

 

In December, the government closed the borders to nonresident foreign nationals through the end of January, but entries were still allowed under the business arrangements. Suga had said the business corridors would be "stopped immediately" if they were linked to a COVID-19 variant. But ruling and opposition parties called for all entries to be suspended regardless of whether such variants were detected.

 

All those who enter the country, including Japanese citizens, may have their names disclosed if they violate the request to quarantine for 14 days, the government said. Furthermore, resident foreigners could have their resident status revoked and may be subject to deportation if they do not comply with the quarantine. Meanwhile, surging coronavirus cases have eaten into the prime minister's approval ratings.

 

The government last Friday announced that during the state of emergency all entrants, including Japanese, would be required to submit proof of a negative coronavirus test within 72 hours of departure. But Suga explained his reasoning for going further on Wednesday. "I have decided to take every possible step and remove any risk in a preemptive fashion, in order to protect the lives of the Japanese people," he said. "This is why I've decided to suspend [the business entry program] temporarily while the national emergency is in effect."

 

Also on Wednesday, Suga said his government was indeed expanding the emergency to the western prefectures of Osaka, Hyogo and Kyoto, the central prefectures of Gifu and Aichi, which includes Nagoya, as well as the southern prefecture of Fukuoka and the eastern prefecture of Tochigi.

Parler Switches Domain Registry to Epik Following AWS Ban

Parler has switched their domain registry to Epik, the pro-free speech company that hosts other New Tech sites such as Gab.

 

Parler was taken offline by Amazon Web Services on early Monday morning, after the Big Tech giant claimed that the microblogging platform could no longer stay on their servers due to posts on their site that allegedly called for violence at the Capitol Hill protests in DC last week.

 

Web domain search results have now confirmed that Parler has switched its domain registry over to being hosted by Epik, a domain registrar who hosts a number of domains from other New Tech sites, including Gab, Parler’s competititor in the free speech microblogging sphere, and Bitchute, the video-sharing, YouTube alternative site.

 

In a statement released on Monday, Epik Senior Vice President for Communications, Robert Davis, said that they had had no discussions or contact with Parler in regards to the organisation switching their registry over, and that Parler was “working on satisfying the requested terms placed upon them by various elements of their supply chain.”

Epik went on to defend Parler in the statement, and slammed the Big Tech companies who had acted to censor them had created an “undeniable double standard for both policing and enforcement” of their terms. In their lawsuit against Amazon, Parler noted that on the same day AWS cut off their hosting, “Hang Mike Pence” trended number 1 on Twitter, and no action was taken against them.

 

The statement also decried the media reporting on Parler and the Capitol Hill protests as blatant “propaganda… employed with the intent of controlling others,” and warned about the potential results of the ongoing “battle between oversized monopolies and smaller platforms”:
