3) There could be a debate and vote on a call by managers to summon witnesses. That would be subject to a simple majority threshold.

 

4) Finally, the trial would go dark Friday night at 5 pm et and resume on Sunday. That’s because David Schoen, one of President Trump’s attorneys, observes the Jewish Sabbath.

Marco Rubio Brings Back Bill Making it Tougher for Suspected Terrorists to Buy Guns

 

Last week, U.S. Sen. Marco Rubio, R-Fla., brought back his bill to make it tougher for suspected terrorists to buy guns.

 

Rubio reintroduced the “Terror Intelligence Improvement Act” which, his office insisted, will “make it harder for suspected terrorists to purchase firearms” and “provide more authority for law enforcement agencies to go after suspected terrorists, while safeguarding law-abiding citizens’ Second Amendment and due process rights.” The Florida Republican has pushed the proposal in recent years with little success.

 

“After the terrorist attack at Pulse nightclub, I made a promise to improve our laws to make it more difficult for evil people to get ahold of guns,” Rubio said last week. “This bill is a common-sense measure that would help ensure criminals, terrorists, and others seeking to take innocent lives are not able to acquire firearms, while also protecting the due process and Second Amendment rights of innocent, law-abiding Americans.”

 

The bill would “consolidate all federal terrorism investigation intelligence under the Federal Bureau of Investigation (FBI), strengthening the FBI’s capabilities and making sure dangerous individuals do not fall through the cracks” and have the FBI director and the Joint Terrorism Task Force (JTTF) notified immediately when an “individual who was the subject of a federal terrorism investigation within the last 10 years” tries to buy a gun.

 

When people who were investigated for terrorism try to buy a gun, the bill would “allow the U.S. attorney general to delay the purchase or transfer for up to ten business days and file an emergency petition in court to prevent the transfer.” If the court finds the individual still has ties to terrorists, the bill would allow the attorney general to arrest the suspect.

 

The bill also seeks to “protect the due process rights of law-abiding Americans by ensuring emergency petitions filed by the attorney general are only granted if the transferee receives notice of the hearing and has the opportunity to participate with legal counsel” and would permit the “Inspector General of the Intelligence Community (ICIG) to conduct an audit of the federal government’s terrorism screening and watch list procedures, and identify any problems in the processes of adding or removing individuals from the system.”

 

Rubio’s bill was sent to the U.S. Senate Judiciary Committee on Tuesday. So far, there are no cosponsors. There is no companion bill over in the U.S. House.

Mexico Steamrolls Biden Administration, Now Outright Refusing to Accept Captured Illegal Immigrants

 

They’ve only been in office for a little over two weeks, but President Joe Biden and his administration are already throwing a 2014 party at the southern border — with Mexico’s help.

 

According to Reuters, officials in Texas are releasing illegal immigrant families from Central America because several Mexican provinces are refusing to take them back. The refusals have led to crowded Border Patrol facilities — and the release of immigrants to shelters.

 

The Biden administration had tried to preclude this. Yes, it introduced an immigration bill that amounted to amnesty — but it ensured that anyone who arrived in the country after Jan. 1 wouldn’t be eligible for the plan, which would provide an eight-year path to citizenship.

 

There was still one migrant caravan determined to make it to the U.S. border despite both the coronavirus pandemic and the Biden administration’s dithering on undoing the Trump administration’s border policies. Now, it might have to deal with yet another situation like the Obama administration saw during the 2014 migrant crisis.

 

The decision not to accept illegal immigrant families “expelled” from the United States has only happened in two sectors of the border, according to The Washington Post. They just so happen to be two of the busiest Customs and Border Protection sectors in terms of illegal crossings — the Del Rio Sector and the Rio Grande Sector.

 

The immigration from Central America — mostly Honduras — began increasing last year and has risen to problematic proportions, according to CBP spokeswoman Stephanie Malin. That’s led to families being released.

 

“CBP has seen a steady increase in border encounters since April 2020, which, aggravated by COVID-19 restrictions and social distancing guidelines, has caused some facilities to reach maximum, safe holding capacity,” Malin said in a statement.“Whenever feasible we are seeking alternatives to detention in cases where the law allows.”

 

This has led to the return of “catch and release,” whereby illegal immigrants are released into the community pending a hearing. According to BuzzFeed News, this means the immigrants are being left in border towns such as Brownsville and McAllen, Texas.

 

“COVID-19 protocols, changes in Mexican law, and limited US holding capacities have forced us to adapt,” CBP said in a statement.

 

“For those migrants who are released, CBP may work with non-government organizations who will assist them through the out-of-custody process.”

 

Former acting Homeland Security Secretary Chad Wolf tweeted about the mounting crisis. “This is heartbreaking,” he said Wednesday. “Catch and release is back for minors and now families. More concerning during COVID as well. This is slowly building to a full blown crisis.

The facial recognition app Clearview AI is not welcome in Canada and the company that developed it should delete Canadians’ faces from its database, the country’s privacy commissioner said on Wednesday.

 

“What Clearview does is mass surveillance, and it is illegal,” Commissioner Daniel Therrien said at a news conference. He forcefully denounced the company as putting all of society “continually in a police lineup.” Though the Canadian government does not have legal authority to enforce photo removal, the position — the strongest one an individual country has taken against the company — was clear: “This is completely unacceptable.”

 

Clearview scraped more than three billion photos from social media networks and other public websites in order to build a facial recognition app that is now used by over 2,400 U.S. law enforcement agencies, according to the company. When an officer runs a search, the app provides links to sites on the web where the person’s face has appeared. The scope of the company’s reach and law enforcement application was first reported by The New York Times in January 2020. …

Brazil Dismantles Anti-Corruption Task Force Behind Lava Jato

 

After having sent nearly 280 people to jail and having retrieved some US$800 million to state coffers, Brazilian prosecutors dismantled last week the so-called Car Wash Task Force that handled the largest anti-corruption probe in the history of the country.

The operation initially looked into a series of illicit transactions linked to a car wash called Lava Jato in the country's capital. However, it rapidly evolved into a complex bribing scheme involving the state's oil company Petrobras and the largest political parties.

 

The investigation shook both Brazilian and Latin American politics and sent to prison four Presidents, including Brazil's Luis Inacio 'Lula' da Silva. It also exposed the tentacles of white-collar corruption across the region and prompted other countries to carry out their own probes.

 

According to a statement from the Attorney General's Office, the nine members that formed the task force were reassigned to Gaeco, a unit fighting organized crime in Brazil. Four prosecutors will continue to pursue investigations related to Lava Jato, while the remaining five will engage in other procedures.

 

Since March 2014, the task force has carried out 1,450 search and seizure warrants and collected evidence against 533 defendants, resulting in 278 convictions, read the statement.

 

The probe additionally had two investigations: Operation Pilot, which revealed in 2018 a money laundering and bribery scheme across Latin America linked to the construction group Odebrecht, and the Integration Operation, which looked into the systematic payment of bribes by Parana toll concessionaires.

 

"The legacy of the Lava Jato Task Force is undeniable and commendable considering the advances we have made in discussing such important and costly issues to Brazilian society. However, there is still a lot of work,” said Alessandro José de Oliveira, coordinator of the Lava Jato unit at Gaeco.

 

The task force comes to an end a year and a half after a leak showed conversations suggesting that Sergio Moro, the former Brazilian justice minister and the judge who jailed Lula Da Silva, did not act impartially.

 

In August last year, President Jair Bolsonaro said he did not want to end the Lava Jato operation, but eventually he did "because there isn't any corruption" to be investigated in his government.

 

OCCRP recently named Bolsonaro the 2020 Person of the Year for his role in promoting organized crime and corruption. The Brazilian President’s links to corrupt figures, the use of propaganda to push a populist agenda, his attacks against the justice system and his continual destruction of the Amazon made him worthy of the unflattering title.

Biden Quietly Revokes Trump’s Ban on Chinese Communist Propaganda in Schools

 

President Biden quietly revoked a Trump-era policy that compelled primary, secondary, and postsecondary institutions to disclose their relationships with Chinese Communist Party-funded Confucius Institutes.

 

The policy – “Establishing Requirement for Student and Exchange Visitor Program Certified Schools to Disclose Agreements with Confucius Institutes and Classrooms” – was proposed on December 31st, 2020.

 

“The rule would require colleges and K-12 schools that are certified to have foreign exchange programs to disclose any contracts, partnerships, or financial transactions from Confucius Institutes or Classrooms (the Confucius Institute offshoot for primary and secondary schools),” Axios noted.

 

And the Trump administration’s proposals were well-warranted: the well-funded, controversial operations disguise themselves as language and culture initiative despite being replete with “undisclosed ties to Chinese institutions, and conflicted loyalties,” Chinese state propaganda, and intellectual property theft, according to the Federal Bureau of Investigation (FBI) and U.S. Department of Justice (DOJ).

 

Records from the Office of Information and Regulatory Affairs, however, reveal that Biden nixed the policy on January 26 – less than a week into his White House tenure.

Gab's underdog success story continues to escalate to new heights in 2021

 

Free speech social media platform Gab received 272 million visits during the month of January, outperforming legacy media competition such as NBC News, The Wall Street Journal, Breitbart, and TMZ by a wide margin. Gab’s success is particularly remarkable, considering the fact that the website has been “deplatformed” from mobile app stores, PayPal, and email marketing services.

 

The official Gab Twitter account revealed that the website had far outperformed legacy media on Monday, posting “Gab: ~272 million in Jan” next to a screenshot of traffic numbers from various corporate legacy media outlets.

Ghislaine Maxwell loses bid to keep deposition excerpt secret

 

NEW YORK (Reuters) - A U.S. judge on Monday rejected Ghislaine Maxwell’s effort to keep under wraps an excerpt from a 2016 deposition that she fears could undermine her criminal trial on charges she aided the late sex offender Jeffrey Epstein and committed perjury.

 

U.S. District Judge Loretta Preska said Maxwell had only a “minimal” privacy interest in the 20-line excerpt, because it concerned massages and not private sexual activity of consenting adults, and the public had a right to see her testimony.

Barr Order Detailing the Scope and Authority of Special Counsel Durham Investigation in Obamagate

On May 13, 2019, I directed the United States Attorney John Durham to conduct a preliminary review into certain matters related to the 2016 presidential election campaigns, and Mr. Durham’s review subsequently developed into a criminal investigation, which remains ongoing. Following consultation with Mr. Durham, I have determined that, in light of the extraordinary circumstances relating to these matters, the public interest warrants Mr. Durham continuing this investigation pursuant to the powers and independence afforded by the Special Counsel regulations. Accordingly, by virtue of the authority vested in the Attorney General, including 28 U.S.C. §§ 509, 510, and 515, in order to discharge my responsibility to provide supervision management of the Department of Justice, and to ensure a full and thorough investigation of these matters, I hereby order as follows:

 

(a) John Durham, United States Attorney for the District of Connecticut, is appointed to serve as Special Counsel for the Department of Justice.

 

(b) The Special Counsel is authorized to investigate whether any federal official, employee, or an other person or entity violated the law in connection with the intelligence, counter-intelligence, or law-enforcement activities directed at the 2016 presidential campaign, individuals associated with those campaigns, and individuals associated with the administration of President Donald J. Trump, including but not limited to Crossfire Hurricane and the investigation of Special Counsel Robert S, Mueller, III.

 

(c) If the Special Counsel believes it is necessary and appropriate, the Special Counsel is authorized to prosecute federal crimes arising from his investigation of these matters.

 

(d) 28 C.F.R. §§ 600.4 to 600.10 are applicable to the Special Counsel

 

(e) Pursuant to 20 C.F.R. § 600.9 (b), I have determined that the notification requirement in 28 C.F.R. § 600.9(a)(1) should be tolled until at least after the November 3, 2020 election because legitimate investigative privacy concern warrant confidentiality.

 

(f) In addition to the confidential report required by 28 C.F.R. § 600.8(c), the Special Counsel, to the maximum extent possible and consistent with the law and the policies and practices of the Department of Justice, shall submit to the Attorney General a final report, and such interim reports as he deems, appropriate, in a form that will permit public dissemination
