You’re instincts are not wrong, but there is a subtlety when the issue is about the charges brought. There are 2 legal constructs you are evaluating (though you don’t recognize them as such). First is something called a lesser included offense. Second is the doctrine of merger. Basically, under merger, the lesser included offense merged into the crime of which a person is convicted. ( A lesser included offense is one where the elements of a less serious crime are also elements of a more serious crime. Think about the crimes of trespass and burglary. To have a burglary, there must be a trespass.) so, basically, if a person is convicted of the more serious offense, the lesser included offense gets merged into that greater offense so you only have one conviction. Here, the charges ( the 3 different counts) were for 3 different types of murder - none of them being identical in elements (mainly different as to the type of intent / mens rea required.) BUT, your instincts are still correct BECAUSE the sentence is likely only going to be for the most serious charge (either of the murder counts and I would argue the third degree deprived heart charge is more “serious” mainly because MN’s felony murder crime is weird and creates appealable issues). But, I digress. I believe MN sentencing guidelines are mandatory and limit the judge to impose the sentence for only the most serious conviction… so all of this nonsense about him getting 80 years is highly unlikely because I don’t think his sentences can consecutively. If this were any regular case, I’d guess the sentence would be between 12-15 years (with early release eligibility after 10 years - but I haven’t looked at MN release/parole statute.) so, there you have it. These are not lesser included offenses and can be charged and convicted separately, but sentences should merge. Does that help??

 

Ok- now someone else help me please. Against my better judgment, I watched Tucker tonight. Interesting ending to the show about Bezos. Tucker challenged him to come on anytime and talk about 1987 (apparently Bezos has something in his past that is unsavory.) Anybody hear anything about this???
