Seven Chinese nationals face 160 counts, many of them relating to the violation of labour laws in South Africa

 

Seven Chinese nationals who were arrested on charges of human trafficking and contravening South Africa’s labour laws, are expected to return to the High Court in Johannesburg on Monday, April 26, 2021.

 

The matter continued the previous week, but had to be adjourned because Chichewe and Mandarin interpreters were not available at the time.

 

The accused – Kevin Tsao, Chen Hui, Qin Li, Jiaqing Zhou, Ma Biao, Dai Junying and Zhang Zhilian – have already been indicted on charges of human trafficking, debt bondage, kidnapping and pointing of a firearm.

 

The four men and three women were nabbed in November 2019 as part of a sting operation conducted by the department’s Inspection and Enforcement Services (IES) branch in Gauteng, the South African Police Service (SAPS), the Department of Home Affairs and the Hawks.

 

CHINESE NATIONALS ACCUSED OF TRAFFICKING 91 MALAWIANS

 

The suspects are said to have trafficked illegal immigrants into South Africa and subjecting them to forced labour. Authorities pounced on them in a factory which staffed with 91 Malawian nationals – including 37 children.

 

The Department of Employment and Labour is involved in the matter and seeking prosecution against the group.

 

“The accused are facing schedule six offences and will face 160 counts relate to contravention of the Compensation for Occupational Injuries and Diseases Act (COIDA), Occupational Health and Safety (OHS) Act, Unemployment Insurance Act, Unemployment Contributions Act, Prevention and Combating of Trafficking in Persons Act, kidnapping, contravention of Immigration Act, knowingly employing illegal foreigners, human trafficking, kidnapping, pointing a firearm, debt bondage, benefitting from the services of a victim of trafficking, conduct that facilitates trafficking, illegally assisting person(s) to remain in South Africa and failure to comply with duties of an employer”

It would later emerge that the victims were transported into the country using containers. The Malawians are alleged to have been brought to South Africa by a middleman known as “the transporter” who is still on the loose.

 

Six out of the seven accused are currently out on bail ranging from R30 000 to R70 000, but have been ordered to adhere to strict conditions that restrict their movement and ability to conduct business.

 

Accused number 7 in the matter, Zhang Zhilian, is currently in custody after she was caught trying to flee the country on 24 February 2021. She was nabbed at the OR Tambo International Airport.

Federal agents execute search warrant on Rudy Giuliani's apartment

(CNN)Federal agents executed a search warrant Wednesday at the Manhattan apartment of Rudy Giuliani, advancing a criminal investigation by federal prosecutors that has been underway for more than two years, according to two people familiar with the matter.

Giuliani, who served as former President Donald Trump's personal lawyer, has been the focus of an investigation concerning his activities in Ukraine, including whether he conducted illegal lobbying for Ukrainian officials while he pursued an investigation linked to Trump's primary political rival, President Joe Biden, CNN has reported. Giuliani hasn't been charged and has denied wrongdoing.

It is unusual for prosecutors to execute a search warrant on a lawyer, although Manhattan federal prosecutors have done so before, most notably in recent years against another former lawyer for Trump, Michael Cohen.

 

Giuliani's lawyer Robert Costello did not immediately respond to requests for comment.

 

A spokesman for the Manhattan US Attorney's office declined to comment. The New York Times was first to report the search.

 

A search warrant for a lawyer like Giuliani would require sign-off by the highest levels of the Department of Justice, likely by Deputy Attorney General Lisa Monaco, according to departmental guidelines.

The Times reported that investigators seized Giuliani's electronic devices, according to one person with knowledge of the matter.

 

The New York federal prosecutors leading the investigation into Giuliani have previously sought a search warrant for him, raising the prospect last year of seeking one for his communications, but they were met at the time with resistance from Justice Department officials in Washington over the strength of their evidence, CNN has previously reported.

Then-Deputy Attorney General Jeffrey Rosen, along with other officials at Justice headquarters and the US attorney's office in Manhattan, decided not to make a final decision, CNN reported, in part because there would soon be a change in the administration.

The New York federal prosecutors wanted to seize Giuliani's devices when they first sought to execute the search warrant last year, CNN previously reported.

Giuliani has been under scrutiny by Manhattan federal prosecutors since early 2019. The inquiry has explored whether Giuliani may have been engaged in undisclosed foreign lobbying for Ukrainian officials when he sought the ouster of the US ambassador to Ukraine as well as an investigation into the Bidens for his own personal benefit at the same time he was pursuing those efforts as Trump's attorney.

 

In 2019, two Giuliani associates, Lev Parnas and Igor Fruman, were indicted on campaign finance charges stemming from an alleged straw donor scheme. Parnas and Fruman met with Giuliani, helping introduce him to Ukrainian officials. They have pleaded not guilty.

Biggs asks Biden to suspend John Kerry’s security clearance

 

After calls for former Secretary of State and Biden administration official John Kerry’s resignation continue, Rep. Andy Biggs (R-AZ) penned a letter on Tuesday to President Biden, demanding that he suspend Kerry’s security clearance. This comes after the reported revelation that Kerry knew about covert Israeli attacks in Syria.

 

The Arizona congressman called for the suspension until a full investigation can be completed. “I urge you to immediately suspend Special Envoy John Kerry’s security clearance and prevent him from participating in any classified briefings until the full nature of his interactions with the Islamic Republic of Iran are investigated,” Biggs wrote.

 

“If Mr. Kerry provided sensitive information to Iran about Israel’s activities in Syria, he undermined a friend and bolstered an enemy,” Biggs wrote. “At best, such behavior would be despicable; at worst, it would verge on treason.”

 

Since the news broke, Biden has remained silent on the issue and Kerry denies the report. But Biggs demands action.

 

“For the sake of national security, I again urge you to act immediately in this matter,” he wrote.
