Boston Fed launches search for new president, hires exec. talent firm

 

The Federal Reserve Bank of Boston has kicked off its search for a new president to replace the bank’s previous top executive, who left last month, it said on Tuesday.

 

The bank’s search is being led by Christina Paxson, the chair of its board and president of Brown University, it said in a statement, and it has hired the executive search firm Spencer Stuart to assist it in recruiting potential candidates.

Evergrande misses interest payments totaling $148 million: report

 

Debt-laden property developer China Evergrande Group has missed interest payments on bonds totaling $148 million, Reuters reported Tuesday, fueling concerns over a possible default by the company.

 

This was the third round of Evergrande's failure in coupon payment in three weeks, following the two other payments it missed in September, the Reuters report said. But the company has not commented on the non-payments. Holders of the Evergrande bonds said they did not receive the coupon payments due by 4 a.m. GMT Tuesday, according to the report.

 

The default on the interest payments could accelerate the risk of large losses in markets as the property developer, whose liabilities have swelled to around 2 trillion yuan ($310 billion), must continue to make massive interest payments on bonds. Trading in the shares of Evergrande has been halted on the Hong Kong stock exchange since Oct. 4, which is believed to be linked to the financial difficulties the company is tackling. The property developer has been keen to expand its business while the real estate market in China has been shrinking against the backdrop of the nation's prolonged trade dispute with the United States and the novel coronavirus outbreak.

 

Evergrande has also dabbled in many businesses, including electric vehicle development, which has inflated its debt.

 

But the company's EV unit said on Monday that it would start manufacturing such vehicles next year, showing its intention of staying in business, though Evergrande has said in August that it considered selling off the unit.

U.S. SEC opens inquiry into Wall Street banks' staff communications

 

The U.S. Securities and Exchange Commission (SEC) has opened a broad inquiry into how Wall Street banks are keeping track of employees’ digital communications, three people familiar with the matter told Reuters.

 

SEC enforcement staff contacted multiple banks in recent weeks to check whether they have been adequately documenting employees’ work-related communications, such as text messages and emails, with a focus on their personal devices, said the people, who spoke on the condition of anonymity. The industry “sweep” is a further sign that the SEC is ramping up enforcement under its Democratic leadership, and highlights the challenges Wall Street banks face keeping track of staff communications in the work-from-home pandemic era.

 

The SEC periodically conducts sweeps to quickly gather information on issues it suspects may be widespread. Sweeps can sometimes, although not necessarily, lead to formal probes. The sweep appears to stem from a probe the agency has been conducting for some time into an individual financial institution, two of the sources said, without naming the firm. In August, JPMorgan Chase & Co disclosed that it had been fielding regulatory inquiries concerning its “compliance with records preservation requirements in connection with business communications sent over electronic messaging channels” that the bank had not approved. It said it was discussing a “resolution” with regulators, without specifying which ones. Spokespeople for the SEC and JPMorgan declined to comment.

 

The SEC and the Financial Industry Regulatory Authority, Wall Street’s self-regulatory body, require broker-dealers to keep records of all business-related communications. Banks have to walk a fine line to comply with those requirements without infringing upon employees’ privacy, said one of the sources. In the United States, there is no clear-cut legal basis on which an employer can demand to inspect employees’ personal communications, while in other countries doing so may breach data protection statutes, the source said. As a result, many financial firms ban the use of personal email, texts and other social media channels for work purposes, but keeping up with a proliferation of communication apps especially during the pandemic is a challenge for companies.

 

In a speech here last week, the SEC's head of enforcement Gurbir Grewal warned that institutions should stay on top of the many "issues raised by the increased use of personal devices, new communications channels, and other technological developments." Failure to retain and produce communication records can impede regulatory investigations, Grewal said in the remarks. Last year, Morgan Stanley fired here two top executives due to the unauthorized use of WhatsApp to discuss work matters.

Southwest Airlines CEO Insists Flight Cancellations Not Linked To Covid Vaccine Protest

 

Southwest Airlines CEO Gary Kelly on Tuesday vehemently denied widespread rumors that the mass cancellations of flights at his airline in recent days were caused by an internal protest over its Covid-19 vaccine mandate, saying while controversial, he has found “no evidence” of correlation between the mandate and the disruptions. Speaking with ABC’s “Good Morning America,” Kelly reiterated the company’s explanation from recent days: that the over 2,000 flight cancellations through Monday were the result of a traffic management program imposed by the Federal Aviation Administration (FAA).

 

He said Southwest was more impacted than other airlines because over half of its fleet “touches the state of Florida,” which is where the FAA programs were targeted. Kelly recognized that Southwest’s vaccine mandate is “controversial” and “not anything I would wish for our company.” However, he stressed the order is from the federal government “and we’re doing our best to comply with that according to the deadlines that have been set.”
