An illicit cell phone was confiscated from former Briarcliff cop Nicholas Tartaglione while he was in federal custody awaiting trial in the killing of four men in Orange County, according to court records.
Correction officers took the phone from Tartaglione on July 3 in his cell at the Metropolitan Correctional Facility in lower Manhattan.
Federal prosecutors said that Tartaglione claimed his cellmate had tossed it to him as officers approached.
The confiscation of the cell phone was first revealed Friday in a letter from Tartaglione’s lawyer, Bruce Barket, to U.S. District Judge Kenneth Karas, expressing concern that privileged material could be on the phone and asking that the federal prosecutors on the case not have access to it.
On Monday, federal prosecutors responded that they anticipated seeking a search warrant to check the phone. They also wanted to know whether the concerns expressed by Barket meant Tartaglione was conceding that the phone was his.
Prosecutors said that prison staff believed the mini-phone was only capable of making voice calls, not sending or receiving written messages.
According to prosecutors, Tartaglione had been involved in a drug ring and Martin Luna owed them money after failing to deliver cocaine.
Tartaglione is accused of killing Martin Luna at the bar and then taking his body to the Otisville property. Prosecutors initially believed that unnamed co-conspirators then killed the other three at the bar before bringing them to the burial site. But a new indictment in April offered a different theory: that the men were brought to Otisville and fatally shot there.
