Morgan Stanley dumped $5 bln in Archegos stock night before fire sale -CNBC
Morgan Stanley sold about $5 billion of Archegos’ stocks the night before the fire sale hit rivals, CNBC reported on Tuesday, citing people with knowledge of the trades. Morgan Stanley had the consent of Archegos, run by former Tiger Management analyst Bill Hwang, to shop around its stock late Thursday, according to the report.
The bank offered the shares at a discount, telling the hedge funds that they were part of a margin call that could prevent the collapse of an unnamed client, CNBC reported. Morgan Stanley did not immediately respond to a Reuters request for comment. Earlier on Tuesday, Credit Suisse said it would take a hit of 4.4 billion Swiss franc ($4.72 billion) from dealings with Archegos Capital Management, prompting it to overhaul the leadership of its investment bank and risk divisions.
Other banks with exposure to Archegos, including Goldman Sachs Group Inc and Deutsche Bank AG, have unwound their trades, Reuters reported on Monday, citing sources with direct knowledge of the transactions.

PG&E Charged With Crimes in 2019 California Wildfire
Pacific Gas & Electric, the troubled utility that has started some of California’s most destructive wildfires, faces new criminal charges, for its role in igniting a 2019 wildfire that burned 120 square miles in Sonoma County north of San Francisco.
The county’s district attorney on Tuesday charged PG&E, which emerged from bankruptcy protection last year, with five felonies and 28 misdemeanors, including recklessly causing a fire with great bodily injury, in connection with the Kincade Fire. The blaze damaged or destroyed more than 400 buildings and seriously injured six firefighters. This is the third set of criminal charges filed against PG&E, California’s largest utility. A jury in 2017 convicted PG&E of charges related to five deaths in a gas pipeline explosion seven years earlier. And the utility pleaded guilty last year to 84 counts of involuntary manslaughter in connection with the 2018 Camp Fire, which was started by its equipment. That fire destroyed the town of Paradise and helped drive PG&E into bankruptcy, where it worked to resolve an estimated $30 billion in wildfire liabilities. California’s Department of Forestry and Fire Protection concluded that the Kincade Fire had started after high winds knocked a cable from a PG&E tower at the Geysers geothermal field. The fire took 15 days to contain, and the district attorney, Jill Ravitch, described the evacuation required in some towns as the largest ever in Sonoma County, a California wine hub.
If convicted, PG&E could face fines and additional penalties for violating a federal probation that stems from the pipeline explosion case. The company has paid billions of dollars to governments, families, insurance companies and others for disasters caused by its equipment, which regulators have said has often been very poorly maintained.

Cherokee was built to generate hydroelectric power during the World War II emergency, but it also plays an important role as one of the chain of TVA-managed reservoirs that have prevented billions of dollars in flood damage over the years. Cherokee Dam is on the Holston River in East Tennessee, 52 miles upstream from the point at which the Holston and French Broad rivers converge to form the Tennessee River. Cherokee Reservoir is named for the tribe of Native Americans who once inhabited the area. The Great Indian Warpath, once followed by Daniel Boone, crossed the basin now filled by the reservoir.

SEC Obtains Emergency Asset Freeze, Charges Actor with Operating a $690 Million Ponzi Scheme
The Securities and Exchange Commission today announced that it obtained an asset freeze and other emergency relief in an emergency enforcement action against Los Angeles-based actor Zachary Horwitz and his company, 1inMM (one in a million) Capital, LLC in connection with an alleged Ponzi scheme that raised over $690 million. Horwitz and 1inMM allegedly told investors that they were buying film rights, purportedly to resell them to Netflix and HBO; in fact, 1inMM actually had no business relationship with either company.
According to the SEC's complaint, Horwitz falsely claimed to have a track record of successfully selling movie rights to Netflix and HBO when, in fact, neither Horwitz nor 1inMM had ever sold any movie rights to, or done any business with, HBO or Netflix. Horwitz allegedly showed investors fabricated agreements and emails regarding the purported deals with HBO and Netflix. The complaint alleges that Horwitz and 1inMM promised investors returns in excess of 35%, and for many years paid supposed returns on earlier investments using funds from new investments. The complaint further alleges that Horwitz misappropriated investor funds for his personal use, including the purchase of his multi-million dollar home, trips to Las Vegas, and to pay a celebrity interior designer. "We allege that Horwitz promised extremely high returns and made them seem plausible by invoking the names of two well-known entertainment companies and fabricating documents," said Michele Wein Layne, Director of the SEC’s Los Angeles Regional Office. "We obtained an asset freeze on an emergency basis to secure for the benefit of investors what remains of the money raised by Horwitz." The SEC's complaint charges Horwitz and 1inMM with violating the antifraud provisions of the federal securities laws. In addition to the asset freeze and other emergency relief granted by the Court, the complaint also seeks a permanent injunction, disgorgement, prejudgment interest, and civil penalties against Horwitz and 1inMM. The Court set a hearing for April 19, 2021, to determine if the asset freeze should remain in force for the duration of the litigation.
The SEC's investigation was conducted by Lance Jasper and Lorraine Pearson and supervised by Spencer Bendell. The SEC's litigation will be led by Kathryn Wanner and supervised by Amy Longo. The SEC acknowledges the assistance of the United States Attorney's Office for the Central District of California and the Federal Bureau of Investigation.
