Judge rules DeVos must testify in lawsuit over student loan forgiveness

 

A federal judge on Wednesday said that former Education Secretary Betsy DeVos must testify in a class-action lawsuit over her handling of student loan forgiveness claims, ruling that “exceptional circumstances” justify the rare deposition of a former Cabinet secretary.

 

Judge William Alsup rejected the joint effort by DeVos and the Biden administration to prevent her from having to testify in the case. The lawsuit is being brought on behalf of roughly 160,000 borrowers who applied to the Education Department for loan forgiveness, on the grounds that they were defrauded by their for-profit colleges.

 

Alsup, a Clinton appointee in the Northern District of California, ruled that DeVos must sit for a three-hour deposition in which attorneys for the student borrowers may question her under oath about the decisions she made regarding the loan forgiveness program.

 

The Trump administration stopped issuing final decisions on the student borrowers’ claims — known as borrower defense applications — for at least 18 months, and then swiftly dismissed large swaths of claims with little explanation provided to each borrower. The Trump administration said it needed this the time to figure out its policy and issue reasoned decisions on borrowers' claims.

 

The freeze in the program happened as DeVos was taking a series of policy steps designed to cut the amount of debt relief that defrauded borrowers can receive under the program. She criticized the Obama administration’s more permissive approach to approving loan forgiveness claims as allowing students to tap into “free money” from the government.

 

Alsup previously ruled that there was a “strong showing” that the Trump administration lied about its actual reason for effectively halting the program and then churning out so many rejections.

New Zealand spending plan includes rebuilding Antarctic base

 

WELLINGTON, New Zealand (AP) - New Zealand plans to rebuild its Antarctic base and spend billions more on welfare payments as part of a spending program aimed at lifting the economy out of a coronavirus slump.

 

The government on Thursday unveiled its annual budget, which indicated the economy is doing much better than forecast after the pandemic first hit.

 

That's thanks in large part to the nation's success in stopping the spread of the virus, as well as strong international demand for the nation's milk and other agricultural exports.

 

Treasury figures indicate the nation's economy is expected to grow by 2.9% this year and rise to 4.4% growth by 2023. That follows a sharp plunge and quick recovery last year, which ended in an overall economic contraction of 1.7%.

 

The budget plan includes $344 million New Zealand dollars ($247 million) to rebuild Scott Base in Antarctica, which has been used by scientists since it was first built in 1957.

 

"The outdated buildings and facilities that keep the residents alive in the coldest, driest, windiest place on Earth have deteriorated," Foreign Minister Nanaia Mahuta said. "Doing nothing would eventually lead to the closure of the base."

NY State Troopers Raid Democrat Mayor’s Home in Rochester, NY — Police Announce It Is a Criminal Investigation

New York State Troopers raided the home of Rochester Mayor Lovely Warren on Wednesday night. Reports say her husband was in handcuffs as the troopers executed a drug warrant at the mayor’s home. Lovely Warren is a Democrat.

 

A criminal investigation was conducted at the home of Rochester Mayor Lovely Warren Wednesday. Troopers executed a search warrant at the Democrat’s house as part of an “ongoing criminal investigation,” New York State Police said in a brief press release. No other information was provided by law enforcement officials.

 

“The Mayor is just learning about the events that unfolded this afternoon and has no more information than the rest of the community,” Rochester’s City Communications Director Justin Roj said in a Wednesday night statement, according to multiple local outlets. “She hopes to learn more details this evening and will have a statement tomorrow.”

Group launches bid to recall Gov. Inslee over handling of the pandemic

A citizen group has launched a bid to recall Gov. Jay Inslee, levying a series of accusations against the governor regarding his handling of the pandemic over the last year.

 

Recall campaign, Kshama Sawant dig in for lengthy battle

 

The group included five charges in its recall filing, alleging the following:

 

That Inslee violated religious freedoms in restricting large gatherings

 

That the rights of residential landlords were infringed upon by the state’s eviction moratorium

 

That he overstepped his authority by suspending the Open Public Meetings Act

 

That he violated state law by suspending large gatherings

 

That he failed to adequately demonstrate a “just cause” for issuing proclamations related to Washington’s declared state of emergency

 

The recall petition still requires court approval to move forward. Should it get that approval, the group behind the effort estimates that it will need roughly 1.5 million certified signatures to get the recall on the ballot.

 

Inslee 'won' reelection in 2020 [through mail-in voting and rigging, with help from Soros-backed Secretary of State Kim Wyman], 'defeating' Republican challenger Loren Culp 56% to 43%, marking his largest ever margin of victory as governor. Culp garnered just over 1.7 million votes.

 

This will mark the second attempt to recall Inslee in recent years. In 2019, Arthur West submitted a recall filing alleging that Inslee “was absent from Washington too frequently” while campaigning for president, and “failed to notify the lieutenant governor of these absences.” West also claimed that the governor had “improperly campaigned for a ballot initiative.”

 

A Thurston County court struck down that petition, finding the charges to be “legally and factually insufficient to submit to voters.” The Washington Supreme Court affirmed that decision, ruling that “West’s petition may have stated reasons to disagree with Governor Inslee, but they were not proper reasons to support a recall.”

 

This is also the latest in a series of high-profile recall efforts in Washington over the last year-plus, including failed efforts to remove Attorney General Bob Ferguson, Snohomish County Sheriff Adam Fortney, Seattle Mayor Jenny Durkan, and Thurston County Sheriff John Snaza. A recall against Seattle City Councilmember Kshama Sawant is currently gathering signatures in hopes of getting on the ballot.
