11.6 PROTECTION OF THE POPULATION OF AN OCCUPIED TERRITORY Under the law of belligerent occupation, the Occupying Power has certain duties with
respect to the population of an occupied territory, including protected persons under the GC.
General Protections, Including Humane Treatment, of the Population of an 11.6.1
Occupied Territory. The population of an occupied territory, like other protected persons under
the GC, are entitled, in all circumstances, to respect for their persons, their honor, their family
rights, their religious convictions and practices, and their manners and customs.107 They shall at
all times be humanely treated, and shall be protected especially against all acts of violence or
threats of violence, and against insults and public curiosity. Other provisions for the humane treatment of protected persons set forth in Articles 27
through 34 of the GC apply to the population of an occupied territory. For example, women
must be especially protected against any attack on their honor, in particular against rape,
enforced prostitution, or any form of indecent assault.108 Reprisals against protected persons and
their property are prohibited.109 The taking of hostages is prohibited.110 In addition, protected persons in occupied territory shall have every facility for making
application to the Protecting Powers, the ICRC, the National Red Cross (Red Crescent, Red Lion
and Sun) Society of the country where they may be, as well as to any organization that might
assist them.111
Overview of Additional Protections for the Population That Are Specific to 11.6.2
Occupation. There are a number of protections for the population of occupied territory that are
specific to occupation. For example, specific provision exists for the protection of children in 757 occupied territory.112 Specific constraints exist on the authority of the Occupying Power to
punish protected persons, direct their movement, or compel them to perform labor.113 Provision
also is made with respect to: (1) food and medical supplies of the population; (2) public health
and hygiene; (3) spiritual assistance; and (4) relief efforts and consignments.114 The following prohibitions also apply with respect to the inhabitants of occupied
territory: 11.6.2.1 Prohibition on Compelling Inhabitants of Occupied Territory to Swear
Allegiance to the Hostile State. It is forbidden to compel the inhabitants of occupied territory to
swear allegiance to the hostile State.115 11.6.2.2 Prohibition Against General Penalties in Occupied Territory. No
general penalty, pecuniary or otherwise, shall be inflicted upon the population on account of the
acts of individuals for which they cannot be regarded as jointly and severally responsible.116
Such penalties are prohibited, even if authorized under the law of the occupied territory. Collective penalties are prohibited as a general matter.117
Occupying Power’s Duty to Respect the Rights of Protected Persons Secured by 11.6.3
the GC. The Occupying Power has certain obligations to respect the rights of protected persons
secured by the GC. Protected persons who are in occupied territory shall not be deprived, in any case or in
any manner whatsoever, of the benefits of the GC by any change introduced, as the result of the
occupation of a territory, into the institutions or government of the occupied territory, nor by any
agreement concluded between the authorities of the occupied territories and the Occupying
Power, nor by any annexation by the latter of the whole or part of the occupied territory.118
The ‘Velvet Hammer’ leads resurgent Blue Dogs
Rep. Stephanie Murphy is leading a newly powerful faction of moderate House Democrats.
Speaker Nancy Pelosi took a veiled shot at Rep. Stephanie Murphy during a closed-door meeting after the centrist Florida Democrat bucked party leaders on a contentious immigration vote.
Pelosi said Republicans were eager to exploit fissures in the early weeks of the new majority, according to a person in the room, and Democrats newly enjoying exclusive committee assignments — like Murphy — can’t be breaking ranks.
Murphy, who was sitting only a few feet away and wearing a “Wonder Woman” T-shirt beneath her blazer, didn’t respond. But months later, she remains unapologetic about the vote, arguing battleground Democrats shouldn’t be expected to fall in line simply to avoid embarrassing leadership on procedural votes.
“Decisions aren’t black or white sometimes, and at the end of the day, members have to vote their districts, especially the ones, I think, who are in more vulnerable seats,” Murphy said in an interview in her Capitol office.
In just her second term, Murphy is suddenly a critical figure in the House as co-chief of the moderate Blue Dog Coalition. Once on the verge of extinction, the Blue Dogs nearly tripled their membership after the 2018 elections and now have 27 members.
And Murphy and the Blue Dogs are proving themselves to be a force — challenging leadership and the caucus’ progressive wing with real success.
Pelosi and her deputies yanked a budget bill from the floor last month in part because of complaints from moderates that it was too expensive. This month, the Blue Dogs are holding up a $15-an-hour minimum wage bill — a key priority for the left — as they look to soften it for rural areas, though Murphy herself supports it. Murphy also helped secure changes sought by Blue Dogs to Democrats’ landmark campaign finance overhaul.

A massive police operation was in Sydney on Saturday morning in anticipation of anti-lockdown protests
About 1,300 police on foot, horseback and in patrol cars swarmed the CBD stopping cars and pedestrians
Authorities wanted to prevent a repeat of the more than 3,500 people turned up for rallies last Saturday
Officers established a command post at Hyde Park and setup a roadblock exclusion zone around the city
NSW reported 210 Covid cases on Saturday with the majority in the south-west and Western Sydney
Up to 1,300 police swarmed Sydney on Saturday and setup a network of roadblocks around the city in a massive show of force to avoid a repeat of last week's violent anti-lockdown protest.
With officers scattered in seemingly every direction across the city, only eight arrests were made - a far cry from the chaotic scenes in the CBD seven days ago.
Police did issue more than 250 Penalty Infringement Notices (PIN) across Sydney, with one man, 45, arrested at a home at Oatley after travelling on trains outside his local government area without a reasonable excuse.
He was taken to Kogarah Police Station and charged after breaching an imposed Public Safety Order (PSO).
In the western suburbs, angry residents saw police helicopters hovering overhead while blaring sirens and broadcasting: 'This is public health order —do not break rules —you will be found and fines issued.'
'This is not the Australia I emigrated to,' a woman from North Parramatta told Daily Mail Australia.
'Cannot believe it. Are they checking we are wearing masks in our gardens? Talk about being treated as suspected criminals.'
