I think I see what’s going on
Every lawyer and legal scholar was surprised that one circuit court judge ruled on Flynn’s dismissal, by he had one that totally went off the rails, stating almost weird language why he/she didn’t agree. Remember the day of deliberation all judges were asking insane and unrelated questions about Flynn’s case. When it finally came down to it, two out of the three were not compromised, but that one that was made a 2-1 judgement to dismiss. Everyone thought, this is a no brainer. That one judge opened the door to En Banc review. So my speculation is:

They were all in on it and wanted it to to En Banc extending the timeline of the completion of Flynn’s freedom or
-
The other judges played along with The dissenting judge to see who would compromise themselves to allow Sullivan to get an En Banc hearing

The whole goal was to have a divided court in En Banc so it would get to the Supreme Court

Why the SC, well it been obvious Roberts have recently ruled I’m the side of liberals I’m the most destructive cases that have nothing to do with the language of the constitution

And finally, but a big stretch: if the SC is divided or rule not based upon constitutional it law, then maybe “The Relevance of The Constitution Should Be Revisited“
Anyway you look at if, it’s a delay tactic, but it could be a lot more than that!
