S&P Dow Jones receives Wells notice from SEC

 

S&P Dow Jones Indices, one of the largest index providers for exchange-traded funds, has received a Wells notice from the U.S. Securities and Exchange Commission (SEC), a filing by New York-based financial-data agency S&P Global showed. The Wells notice was issued to the index provider for failing to provide sufficient disclosures on some volatility-related indexes in 2018, according to the filing from Tuesday.

 

The SEC is planning to file an enforcement action against the index provider, a joint venture between S&P Global and exchange operator CME Group CME.O, the filing said. "The proposed action would allege violations of federal securities laws with respect to the absence of disclosure of a quality assurance mechanism and the impact of that mechanism on certain volatility related index values published on one business day in 2018," S&P Global said in the filing. "The Staff's recommendation may involve a civil injunctive action, a cease and desist proceeding, disgorgement, pre-judgment interest and civil money penalties." A Wells notice does not necessarily mean the SEC will bring any action against the company or that the recipient has violated any law. S&P Global did not immediately respond to an email seeking comment.

Gold settles at record to close out week, notches best monthly gain since 2012

 

Gold futures on Friday finished at a record and notched gains for the month and week as appetite for bullion persisted as concerns grew about the outlook for the economy and the market amid the COVID-19 pandemic. December gold GCZ20, 1.14% GC00, 2.42%, which is now the most-active contract, settled at $1,985.90 an ounce Friday, up 1%, or $19.10. For the month gold climbed by about 10.5%, while it notched a nearly 5% gain, marking its best week since March, according to Dow Jones Market Data.

Keep an eye out for the COMEX paper drops going forwardโ€ฆ.on Silver especially.

The Dec contract has quite the open interest (Gold) and the COMEX does not have the physical supply to deliver should most of the contract holders decide to not roll over and stand for delivery.

In 2010-11 the COMEX was faced with a similar dilemma and resorted to cash payouts to the contract holders to stand down-this is against it's own laws of operation however with everything financial if you do not like the results just change or do not pay attention to the rules.
