US Appeals Court Overturns Death Sentence of Boston Marathon Bomber Tsarnaev

 

Dzhokhar Tsarnaev, a 27-year-old Kyrgyz-American man found guilty in 2015 of the Boston Marathon bombings two years prior, has had his death sentence overturned by a US appeals court on Friday.

 

On Friday, the 1st US Circuit Court of Appeals in Boston upheld much of Tsarnaev's conviction, but ordered a lower court to hold a new trial to decide on the punishment for the crimes for which the death penalty is a possible punishment. Those include usage of a weapon of mass destruction resulting in death, as well as aiding and abetting.

 

"On remand, then, the district court must enter judgments of acquittal on the relevant §924(c) charges, empanel a new jury, and preside over a new trial strictly limited to what penalty Dzhokhar should get on the death-eligible counts," the court decision reads.

 

"And just to be crystal clear: because we are affirming the convictions (excluding the §924(c) convictions) and the many life sentences imposed on those remaining counts (which Dzhokhar has not challenged), Dzhokhar will remain confined to prison for the rest of his life, with the only question remaining being whether the government will end his life by executing him," the court continued.

 

Tsarnaev's lawyers argued in the appeals case late last year that his trial was not fair because it was held in Boston, where the bombings occurred. As of Friday, no date for his execution had been set. A previous attempt at securing a retrial in 2016 failed.

 

Dzhokhar Tsarnaev and his brother, Tamerlan, were previously found guilty of placing the bombs that killed three people and injured 280 others who were part of the crowds near the finish line for Boston's annual marathon race on April 15, 2013. While Tamerlan died that day after being shot by police, Dzhokhar was sentenced to death in June 2015.

Trump Admin Sanctions Chinese Paramilitary Group Engaged in Mass Human-Rights Abuses

 

New sanctions mark escalation in U.S. campaign to expose China's abuse of minorities

 

The Trump administration on Friday issued a set of sanctions on a Chinese paramilitary organization that U.S. officials say is complicit in the Communist regime’s systematic abuse and detention of ethnic minorities.

 

New sanctions were leveled on two Communist Party officials and the Xinjiang Production and Construction Corps (XPCC), a paramilitary group that has imprisoned, abused, and detained minority groups such as the ethnic Uyghur population, according to the State and Treasury Departments. The blacklisting of the XPCC freezes its assets and blocks Americans from doing business with it due to what the Treasury Department labeled as "serious rights abuses against ethnic minorities in the Xinjiang Uyghur Autonomous Region."

 

The sanctions mark a major escalation in the Trump administration’s efforts to expose China’s mass human-rights abuses and use of forced labor camps. Senior Trump administration officials familiar with the effort described the sanctions as unprecedented and said the administration would continue to penalize China for its human-rights abuses that are on scale with atrocities committed during World War II. The escalation in the administration’s growing standoff with China comes just a week after it shut down a Chinese consulate in Houston, where CCP officials allegedly conducted espionage operations, including the theft of U.S. medical research.

 

"The Chinese Communist Party’s human-rights abuses in Xinjiang, China, against Uyghurs and other Muslim minorities rank as the stain of the century," Secretary of State Mike Pompeo said in a statement. "The Trump administration has led the world’s effort to impose tangible costs on the PRC’s continuous campaign of repression, mass arbitrary detention, intrusive surveillance, forced labor, forced population control, involuntary collection of biometric data, and genetic analyses targeted at these groups."

 

In addition to sanctioning the XPCC itself, the administration also targeted Sun Jinlong, a former political commissar of the XPCC, and Peng Jiarui, a deputy party secretary and commander of the XPCC. The sanctions are being applied under the Global Magnitsky Human Rights Accountability Act, which is used to expose human-rights violations across the globe.

Trump doubles down, warns November will bring 'greatest election disaster in history'

 

'People oughta get smart,' Trump said

 

President Trump doubled down Friday on his warnings surrounding expanded mail-in ballots, declaring November will bring the “greatest election disaster in history” a day after he controversially suggested delaying the vote.

 

“They think they’re going to send hundreds of millions of ballots all over the United States and it’s gonna come out,” he told reporters at the White House following a meeting with members from the National Association of Police Organizations. “You won’t know the election result for week months, maybe years after. Maybe you’ll never know the election result. That’s what I’m concerned with – it’ll be fixed. It’ll be rigged. People oughta get smart.”

 

He suggested people vote in person or submit absentee ballots.

 

"This is going to be the greatest election disaster in history," he continued on Friday. "And by the way, you guys like to talk to about Russia and China and other places? They'll be able to forge ballots, they'll forge them. They'll do whatever they have to do."

 

The president has repeatedly raised concerns involving broad mail-in voting, which is expected to be more widely used in the November election out of concern for safety given the COVID-19 pandemic. Republicans have drawn a distinction with standard absentee ballots given the process in place to obtain one.

 

But on Thursday, Trump caused a firestorm when he floated the idea of delaying the election until it could be conducted in person. Trump has no authority to do so, as the Constitution gives Congress the power to set the date for elections, and even Republicans pushed back at the suggestion.

 

At Thursday's White House briefing, Trump claiming universal mail-in balloting could delay the election results for weeks or even months after Election Day.

 

"You're sending out hundreds of millions of universal mail-in ballots. Hundreds of millions. Where are they going? Who are they being sent to? It's common sense," Trump said. "I want an election, and a result, much more than you. I think we're doing very well. … I don't want to see a rigged election."

 

On Friday, he insisted he wants the election to take place, and even said, "I wish we'd move it up, okay?"

 

He said officials are working to fix the issue, but said the government was "not prepared for an onslaught of millions of ballots pouring in."

 

"Absentee ballots, great. Going to the polls, great," he added. "If you do universal mail-ins with millions and millions of ballots, you're never gonna know what the real result of an election is. It's gonna be a very, very sad day for our country."

 

Trump cannot change the election date without the approval of Congress, and policymakers in both parties have largely made clear they would oppose such a move.

 

Earlier this month, NAPO endorsed Trump for president, after endorsing then-Vice President Joe Biden in both the 2008 and 2012 elections.

 

In announcing NAPO's support for Trump, President Michael McHale wrote Trump's support is necessary “during this time of unfair and inaccurate opprobrium being directed at our members by so many.”

 

“We particularly value your directing the Attorney General to aggressively prosecute those who attack our officers,” McHale wrote in the letter.

Pelosi Funnels $14,000 to Ilhan Omar

 

Campaign Amid Expensive Primary Fight

Pelosi looks to bail out freshman who once attacked her leadership

 

House Speaker Nancy Pelosi (D., Calif.) funneled $14,000 to Rep. Ilhan Omar's campaign in late July as the Minnesota Democrat struggled to fend off a well-funded primary challenge.

 

Federal Election Commission records released Thursday show that Pelosi transferred $10,000 from her PAC and an additional $4,000 from her campaign committee to Omar on July 22, one week after Pelosi endorsed Omar in her reelection bid.

 

The Minnesota Democrat is facing an expensive primary battle against attorney Antone Melton-Meaux, who outraised Omar significantly in the second quarter of 2020. Melton-Meaux raked in $3.3 million between April and June to Omar's $470,000. Included in the challenger's donor list is Democratic Colorado governor Jared Polis, who gave $1,000 to Melton-Meaux's campaign on July 27.

 

The impressive fundraising haul allowed Melton-Meaux to spend more than $1.7 million over the first three weeks of July. Omar, meanwhile, spent just $784,000. More than $600,000—77 percent of those disbursements—went to a D.C.-based consulting firm run by Omar's new husband.

 

Following his spending spree, Melton-Meaux holds $695,000 on hand, down from the $2 million he held at the end of the second quarter. Omar holds $732,000 on hand.

 

Omar, who did not respond to a request for comment, will square off against Melton-Meaux and three additional Democratic challengers during the state's August 11 primary election. The late push from Pelosi suggests genuine concern for Omar, who has butted heads with the California Democrat in the past. Pelosi criticized Omar for using "deeply offensive" anti-Semitic tropes in February 2019 and condemned the Boycott Divestment and Sanctions (BDS) movement against Israel, which Omar supports, a month later. Omar quickly hit back, saying, "a condemnation for people that want to exercise their First Amendment rights is beneath any leader." Melton-Meaux has campaigned against Omar's support for BDS.

 

While both Omar and Melton-Meaux have earned a number of prominent local endorsements, Melton-Meaux has outraised Omar within Minnesota's Fifth Congressional District. The Democratic challenger raised $273,000 from the district's constituents in the second quarter, while Omar raised just $8,000.

 

Neither Pelosi nor Melton-Meaux responded to a request for comment.

The World Health Organization has suddenly gone from crying "The sky is falling!" like a cackling Chicken Little to squealing like a stuck pig.

 

The reason: charges that the agency deliberately fomented swine flu hysteria. "The world is going through a real pandemic. The description of it as a fake is wrong and irresponsible," the agency claims on its Web site.

 

A WHO spokesman declined to specify who or what gave this "description," but the primary accuser is hard to ignore.

Indeed, the chairman of its influential health committee, epidemiologist Wolfgang Wodarg, has declared that the "false pandemic" is "one of the greatest medicine scandals of the century."

 

Even within the agency, the director of the WHO Collaborating Center for Epidemiology in Munster, Germany, Dr. Ulrich Kiel, has essentially labeled the pandemic a hoax. "We are witnessing a gigantic misallocation of resources [$18 billion so far] in terms of public health," he said.

 

They're right. This wasn't merely overcautiousness or simple misjudgment. The pandemic declaration and all the Klaxon-ringing since reflect sheer dishonesty motivated not by medical concerns but political ones.

 

Unquestionably, swine flu has proved to be vastly milder than ordinary seasonal flu. It kills at a third to a tenth the rate, according to U.S. Centers for Disease Control and Prevention estimates. Data from other countries like France and Japan indicate it's far tamer than that.

 

Indeed, judging by what we've seen in New Zealand and Australia (where the epidemics have ended), and by what we're seeing elsewhere in the world, we'll have considerably fewer flu deaths this season than normal. That's because swine flu muscles aside seasonal flu, acting as a sort of inoculation against the far deadlier strain.

 

Did the WHO have any indicators of this mildness when it declared the pandemic in June?

 

Absolutely, as I wrote at the time. We were then fully 11 weeks into the outbreak and swine flu had only killed 144 people worldwide–the same number who die of seasonal flu worldwide every few hours. (An estimated 250,000 to 500,000 per year by the WHO's own numbers.) The mildest pandemics of the 20th century killed at least a million people.

 

But how could the organization declare a pandemic when its own official definition required "simultaneous epidemics worldwide with enormous numbers of deaths and illness." Severitythat is, the number of deathsis crucial, because every year flu causes "a global spread of disease."

 

Easy. In May, in what it admitted was a direct response to the outbreak of swine flu the month before, WHO promulgated a new definition matched to swine flu that simply eliminated severity as a factor. You could now have a pandemic with zero deaths.

 

Under fire, the organization is boldly lying about the change, to which anybody with an Internet connection can attest. In a mid-January virtual conference WHO swine flu chief Keiji Fukuda stated: "Did WHO change its definition of a pandemic?
