A federal judge ordered election officials to count thousands of mail-in ballots throughout New York State that were declared invalid for not having a post-mark or arriving at offices shortly after the June 23 primary.
In granting the preliminary injunction Monday, Manhattan Judge Analisa Torres said the plaintiffs who brought the suit — including congressional candidate Suraj Patel and Brooklyn Assembly candidate Emily Gallagher — had proved that voters were disenfranchised and denied their constitutional rights after being encouraged to vote by absentee ballot during the coronavirus pandemic.
A major problem: Thousands of ballots that had stamps pre-paid by New York State were not post-marked by the Postal Service, particularly those coming from Brooklyn voters. But most other ballots were post-marked.
If such a post-marked ballot was not received by election officials by June 23, it was not counted.
Many ballots arrived at the elections board a day or two after the primary election because voters did not receive them in the mail from the Postal Service until Election Day.

But the ruling may not affect the outcome of the June 23 primary: Rep Carolyn B Maloney is still ahead of Democratic challenger Suraj Patel by about 3,700 votes.
Under Judge Torres' decision, ballots received on June 24 - the day after Election Day - will be counted "without regard to whether such ballots are postmarked by June 23", according to the New York Times.
Patel praised the decision and said the fiasco could foreshadow possible complications in the November presidential election.
“This is no longer a Democratic or a Republican fight, this is not an establishment versus progressive fight,” he told the Times.
“This is now a fight for the voting rights of millions in a pandemic.”

Yang v. New York State Board of Elections: On May 5, 2020, Judge Analisa Torres, of the United States District Court for the Southern District of New York, ordered the New York State Board of Elections to reinstate the Democratic presidential preference primary, which the board had previously canceled, on June 23, 2020. The order came as the result of a lawsuit filed on April 28, 2020, by Andrew Yang, a former candidate for the Democratic presidential nomination, and several candidates for New York's delegation to the Democratic National Convention. In their formal complaint, the plaintiffs alleged that "this unprecedented and unwarranted move infringes the rights of Plaintiffs and all New York State Democratic Party voters … as it fundamentally denies them the right to choose our next candidate for the office of President of the United States."
In her ruling, Torres sided with the plaintiffs, writing, "[T]he removal of presidential candidates from the primary ballot not only deprived those candidates of the chance to garner votes for the Democratic Party's nomination, but also deprived their pledged delegates of the opportunity to run for a position where they could influence the party platform, vote on party governance issues, pressure the eventual nominee on matters of personnel or policy, and react to unexpected developments at the Convention."

A judge on Thursday postponed for two months the trial for two jail guards charged with failing to make required checks on Jeffrey Epstein in the hours before his death.
U.S. District Judge Analisa Torres moved the date from April to June 22 after defense lawyers said they needed more time to prepare for trial. The lawyers had sought a six-month delay.

Acting on a petition from the Brooklyn Federal Defenders office, U.S. District Court Judge Analisa Torres said the immigrants were entitled to a temporary restraining order because of the danger to their health posed by being in county jails that many experts consider a breeding ground for the virus.
“The risk that Petitioners will face a severe, and quite possibly fatal, infection if they remain in immigration detention constitutes irreparable harm warranting a TRO,” wrote Torres, an appointee of President Barack Obama.
In her order issued Thursday evening, Torres also sharply criticized Immigration and Customs Enforcement officials for inadequate preparation for the outbreak and a lack of safeguards for the most vulnerable detainees.
“Respondents have exhibited, and continue to exhibit, deliberate indifference to Petitioners’ medical needs,” the judge wrote.
She noted that ICE-claimed detainees are being screened for the virus, isolated if suspected of infection and that cleaning of facilities has been stepped up.
However, Torres called those measures “patently insufficient to protect” the detainees in the case before her and she noted that lawyers representing ICE could not provide “any information about steps taken to protect high-risk detainees.”
