Northern Michigan orchard sues Gov. Gretchen Whitmer to prevent shutdown of business

 

The orchard and market defies Whitmer’s executive orders 2020-153 and 2020-161, which requires mask-wearing and following other COVID-19 mitigation guidelines. Richard Friske and his family, who own the market, allows customers to “make personal choices regarding their health,” according to the release.

 

The lawsuit claimed that Whitmer and state agencies are attempting to revoke business and health licenses for not adhering to executive orders. The Court of Claims ruled in June that the penalty for violating the orders is a misdemeanor, up to 90 days in jail or a $500 fine.

“The Court of Claims has already ruled that the Governor cannot weaponize her state agencies to prosecute a business for violating her EOs,” the release stated. “Yet the Governor continues with her administrative actions against Friske in direct contempt of this prior court order.”

 

The Governor’s office does not comment on pending litigation, said Whitmer’s spokeswoman Tiffany Brown.

 

“Wearing a mask is an effective and low-cost way to protect ourselves and our families from a deadly disease. It should be—and is—the responsibility of every Michigander,” according to Executive Order 2020-153.

 

Kallman’s release argued that the goal of Whitmer’s executive orders has already been achieved, including “flattening the curve” and not “overwhelming hospitals.”

 

“Despite a very high survival rate for those who do contract the virus, and the fact that the majority of deaths occur in nursing homes and elder care facilities, the government iswilling to destroy any business that won’t comply with its unlawful EOs,” the release stated.
