I think Kyle is going to come out as a justified homicide if he claims self defense and doesnt plead down.

 

I've always learned there are 3 things when considering justifiable homicide. Ability, Opportunity, and Jeopardy. You have to have a level of all three to be considered a justfiable use of deadly force.

 

Baldy had the ability to cause him bodily harm by being an older man to his 17 year old boyish frame (also a disparity of force) He also was throwing items. Kyle showed deadly intent by open carrying. He retreated away from conflict and baldy followed him while attacking him from a distance. Kyle kept running and baldy caught up to him.he now has the "opportunity" to cause bodily harm to kyle. Kyle, with the knowledge that he knew that baldy knew he was armed you can now reasonably assume that baldy is also coming in with deadly intent which puts him in 'jeaporady". also keep in mind earlier in the night baldy was threatening his group.

 

Him travelling might cause an issue. Unless he told his buddies or is on tape saying he's going there to murder other's i think you can reasonably conclude that wasn't his intent. there were hundreds of other out of town armed protestors the event and with the knowledge of violence i think its reasonable to come armed. However this will be the cornerstone of the case.

 

Kyle handled this perfectly and did everything he was supposed to do. The facts of the second shooting are so on his side he will not even be charged for those. He kept fleeing towards the police. The attackers had no basis to confront kyle unless they SAW him commit the crime. You can't attack someone because you think they did. He also had disparity of force because the number of attackers surrounding him. When he tripped and fell he is now vulnerable and the disparity of force becomes even greater (this is essentially a multiplier). He is now in massive danger of extreme bodily harm. The attackers also had weapons, hitting him with skateboards, and one attacker pulled a glock on Kyle. One attacker tried to stomp his head. The attacker who died tried to disarm him. He showed extreme control by not following up more shots on the attacker who had the glock. That attacker never dropped the gun but Kyle felt he wasn't a threat anymore. this further shows his state of mind and how he didnt come there to do harm.

 

i am not a lawyer but as a daily ccw holder I read up on this stuff for just in case. I think this will be a textbook example of what to do during an attack AND also what not to do by putting yourself in the situation by attending a protest.
