Assange’ big problem is that he crossed the line between being a passive recipient of classified docs, which he then published, and actively participating in the acquisition (or attempted acquisition) of classified material.
He encouraged (incited) Bradley Manning and attempted to assist with password hacking.
If he had just stuck to receiving and publishing, he wouldn’t be in so much trouble. IMHO.
