great speculation from shipwreckedcrew re. Dannehy resigning from Durham Team

 

prolly posted earlier but optomistic view from one of the best patriots

 

my brief synopsis:

 

She was a skilled/trusted person who fulfilled role to Filter testimony/evidence (thus the 6-12 month assignment) so that material contained in IG Report which was 'compelled' was not known to investigators/prosecutors in a criminal case.

 

Garrity vs New Jersey case/rule says that testimony/admissions compelled/given by a person to their employer (under threat of adverse action by employer for failure to answer) is disqualified in a criminal trial (unless it can be sourced/confirmed in another way independent from persons testimony). Reason is that a person is compelled by employer to answer and is thus denied rights of 5th amendment which is the standard for criminal rights.

 

So Dannehy's role may have been to filter evidence from IG report and determine what evidence could be used and forwarded to Durham team and what was not admissable. Apparently Durham Team could not even look at some evidence or it would taint/bias the investigation, so it was Dannehy's job, and a very important one at that to determine.

 

So equal justice under the law is a forward looking statement, since Dems/DS ignore the law, but we may be moving along at even having a equal right to prosecute laws against them.
