Lisa Murkowski says she won't vote on a justice to replace Ruth Bader Ginsburg before the election: 'Fair is fair'

 

If three more Republicans defect, the prospect of a pre-election replacement is doomed

 

Ruth Bader Ginsburg's death was barely announced before speculation began to run rampant on the internet about whether Republicans will attempt to confirm a nominee to replace her prior to the 2020 election.

 

The speculation is perhaps understandable. Most polls show President Donald Trump trailing Democratic presidential nominee Joe Biden in the general election, and a number of Republican senators in swing states are also trailing their Democratic opponents, meaning that Democrats believe that waiting until after the election will substantially increase the chances that a justice more to their liking will end up taking Ginsburg's place on the Supreme Court.

 

Republicans currently control 53 seats in the United States Senate, so they theoretically could force a nominee through before the election. In light of all this, some senators who are considered likely swing votes have already been approached by the media and asked if they plan to allow a vote on a replacement for Ginsburg.

 

One Republican senator, Alaska's Lisa Murkowski, has already indicated that she will not support such a vote.

Murkowski's remark that "fair is fair" is presumably a reference to the fact that Republican senators did not allow a hearing for former President Barack Obama's nominee Merrick Garland in 2016 during an election year.

 

Murkowski's position does not come as a surprise. Murkowski was asked about the possibility in August, back when it was merely a hypothetical, and she said then that she would not support such an attempt.

Maine Senator Susan Collins (R) also indicated some weeks ago that she would not support seating a replacement justice in October.

If both ssenators hold true to their positions, and no Democrats defect, that would mean that even two more Republican defections would doom any attempt to confirm a replacement for Ginsburg on the Supreme Court before the election.

Are The COVID-Lockdowns An Election 2020 Ransom Note?

 

 

“We don’t realistically anticipate that we would be moving to either tier 2 or reopening K-12 schools at least until after the election, in early November.”

 

Those are the words of a west coast health director. No in-person schooling until after the election? Hmmm.

 

Please think about what was said. It reads as kind of a ransom note. Vote for science-reverent candidate Joe Biden, or else…

 

Really, what else could the utterance mean? What does November 3rd have to do with re-opening schools? Why would it be safer to open on the 4th of November versus the present?

 

Unless the implicit point is that corona-reverence is far more political than the believers have previously felt comfortable admitting. If so, what’s happening borders on child abuse. Kids will be held hostage by an election?

 

Think about what this means.

 

For one, not every parent can afford a babysitter. More than some want to acknowledge, there’s a “day care” quality to schooling. And when school isn’t in person, parents without the means to hire babysitters either must reduce work hours, leave their kids without supervision, or quit work altogether.

 

Day care aside, what about the kids? While there’s an argument that the learning aspect of education is a tad overstated, does anyone think virtual learning will be very effective? With kids? For the adult readers done with school, think back to how attentive you were on substitute teacher days. Does anyone think a lot of learning is happening remotely?

 

What about kids with disabilities? How can they be instructed effectively via Zoom?

 

On a Frontline episode from last week titled “Growing Up Poor In America,” one of the impoverished kids had an ADHD problem. She was expected to learn virtually. Anyone want to guess how this will turn out? Some may respond that ADHD says much more about young people than it does a specific affliction, which is precisely the point. Young people need the structure of a classroom. They need to know they could be called on in class only to face the stares of fellow students if they lack an answer. Pressure concentrates the distracted mind.

 

The girl with attentiveness problems has an older sister. Understand that the Frontline episode followed three poor families during the spring. Her older sister was supposed to attend the prom. It was going to be her first date. Compassionate politicians and teachers took this exciting first from her.

 

Is the point that public school teachers don’t feel safe? If so, isn’t the right answer to give those uncomfortable returning to work an out, as opposed to discontinuing in-person schooling altogether?

Michigan Allows ‘Ballot Harvesting’ for More than Four Days

 

A Michigan court decision that will extend the deadline for postmarked mail-in ballots to be received up to 14 days after Election Day will also allow ballots to be submitted by third parties — a practice called “ballot harvesting” — during a specific period.

 

As Breitbart News reported earlier Friday, Michigan Court of Claims Judge Cynthia Stephens ruled that mail-in ballots postmarked by November 2 — the day before Election Day — will still be counted in Michigan in the 2020 election.

 

In addition, Judge Stephens said that strangers can return other people’s ballots — normally a felony — between 5:01 p.m. on Friday, October 30, and 8:00 p.m. on November 3, the moment that polling places are supposed to close on Election Day.

 

Judge Stephens wrote:

 

This court enjoins MCL 168.932(f) in this election from 5:00 p.m. Friday October 30, 2020 until the close of the polls on November 3, 2020, in so far as it limits the class of persons who may render an absent voter assistance. As a result, a voter casting an absent voter ballot in the November 2020 general election may select any individual the voter chooses to render assistance in returning an absent voter ballot, but only for the limited time period when assistance from the clerk is not required, i.e., between 5:01 p.m. on the Friday before the election and the close of polls on Election Day.

 

The ruling means that anyone may return the ballot of another voter in that period of time, not just those specified by law (such as immediate family members).

 

Normally, a voter can seek assistance from the clerk until 5:00 p.m. on the Friday before Election Day. The judge reasoned that the coronavirus pandemic, among other factors, made that an unconstitutional burden on absentee voters:

 

[I]n ordinary times, the statute likely poses no constitutional issue. These are not, however, ordinary times. As noted, there are documented instances in this case of absentee voters who received their absent voter ballot shortly before the August 2020 election, despite a timely request for such a ballot. As noted, a voter is only guaranteed to receive help from the clerk if the voter makes a request before 5:00 p.m. on the Friday before Election Day. The very real risk of receiving an absent voter ballot in an untimely fashion increases the risk that voters who are otherwise without a statutorily enumerated person to help return their ballot will not be able to take advantage of the fail-safe option of receiving assistance from the clerk. One can think of residents in an assisted living facility, the access to which has been extremely limited during the pandemic, who might fall into this category. Additionally, prospective absentee voters who simply wish to take their time in weighing which candidates to vote for run the risk of missing out on the clerk- supplied assistance. Such individuals might be hesitant, or unable, to receive assistance from family members or household members due to health concerns associated with the COVID-19 pandemic. Or the health risks inherent with COVID-19 might prevent such a voter from returning a ballot in-person. Therefore, and under the current circumstances, the Court is convinced that the time deadline imposed on the fail-safe option of seeking assistance from the clerk risks leaving too many voters without the opportunity of receiving assistance in returning their ballots.

 

The judge did not limit the number of ballots that an individual may return for another person, nor did the judge impose an identification requirement or a background check of any kind.

Maskless Joe Biden Greets Firefighters After Touting Mask Mandates

 

A maskless Joe Biden (D) spoke to firefighters following CNN’s town hall in Pennsylvania on Thursday evening after touting mask mandates and criticizing the president for supposedly thinking that masks “don’t matter very much.”

 

According to a pool report, Biden stopped to speak to firefighters after Thursday evening’s town hall and thanked them for their service. However, a photo from the brief conversation shows the former vice president greeting them without a mask, despite repeatedly criticizing President Trump over the issue:

Prior to speaking with the first responders, Biden participated in CNN’s town hall and blasted the president over his handling of the coronavirus pandemic and the lack of universal masking, specifically.

 

“There’s a whole range of things we should have done. I laid it out all the way back in March how we should do that. The President is totally disregarded it,” Biden said. “He continues to think that masks don’t matter very much.”

 

“He always says it, and then he has these large gatherings with everybody around with no masks on, and it’s extremely dangerous,” he continued.

 

Last month, Biden proposed a three-month mask mandate, covering anyone in any location, even outdoors, but he admitted on Thursday that he would not be able to force Americans to comply. However, he suggested he would be able to enforce it on Federal property.

 

“What Presidents say matter, people listen. I will make it clear what is needed to be done. I cannot mandate people wearing masks, but we just been told if we should expect another 215,000 dead by January. But if we wore a mask, we’d save 100,000 of those lives,” Biden said. “Doing nothing but that.”

 

Biden added that he would call “every governor in the country into the White House” and instruct them to issue mask mandates.

 

“And if they don’t, I’d call the mayors in their towns and their cities and say put out mandates. You can save lives,” he continued.

 

Notably, Biden acknowledged his lack of a mask during CNN’s town hall, telling viewers that he tested negative for the virus that morning.

 

“Still, I’ll be keeping my distance as well, all of the participants in tonight’s Town Hall who are here,” he added.

 

Biden is hardly the only high profile figure to contradict his or her own position on wearing masks. Dr. Anthony Fauci came under fire in July after photos emerged, showing the White House Coronavirus Task Force member enjoying the view at the Washington Nationals’ season opener with a mask hanging around his chin:
