I just realizedโ€ฆ 'both Collins and Murkowski are up for reelection this cycle.

Based on the duration of the Justice K confirmation process I was thinking that forcing this through before Election Day would be impractically difficult. However, there may be an advantage in having the final vote days before those two have to face the voters. If either of them become a problem then they'll getslaughteredat the polls. This will put great pressure on them to behave.

And if it's done days after the election then Senators who just lost their seats may be bitter and would have nothing to lose. Not ideal.

The option of doing it after January would be easier (we'll likely pick up a few seats), but comes with the risk of a 4-4 court in the unlikely event that ballot counting becomes a Federal issue.

 

Alright, I'm onboard with the prompt confirmation option, optics be damned.

Depends on the specific issue they're deciding. A 4-4 is a null decision. No effect. So it depends on which side is coming to them to ask them to override or block what.

"These ballot we found in the back room were rejected! They should be counted!" or "Hey, those ballots don't have clear chain or custody! They shouldn't have been counted!"

What a null decision means depends on which way the battle is being fought.
