RBG's "dying wish," as well as her prior public statements regarding Trump, evidence impartiality and prejudice against Trump. While the Supreme Court lacks a Code of Ethics (unlike all other Federal judges,) the justices are bound by 28 USC ยง 455, which requires a justice to disqualify him/herself in any proceeding in which their impartiality might reasonably be questioned. If the election results end up as a question before the Supreme Court, RBG would have been required to disqualify herself from the case. Good riddance.

>How can she still serve?

Correct. She would also be required to disqualify herself from a case in which Trump is a party of interest.
