Veteran federal prosecutor to lead grand jury probe into James Scurlock's death.

 

A veteran federal prosecutor was tabbed Monday to lead a grand jury investigation into the May 30 shooting death of a 22-year-old black man by a white bar owner in downtown Omaha.

Frederick D. Franklin, a long-serving federal prosecutor, will lead the grand jury of 16 citizens and three alternates as they probe the death of James Scurlock. Presiding Douglas County District Judge Shelly Stratman appointed Franklin.

Okay, I'm no lawfag, but how does that work? A county judge appoints a US Attorney to hold a Grand Jury in a case involving State crimes? No mention of Federal Civil Rights violations or any other potential Federal crime.

Franklin, a Chicago native, is a 1986 graduate of the Creighton University School of Law who has served as an attorney since that time.

Franklin has been an assistant U.S. attorney in Nebraska federal courts for 22 years and has served as the president of the Midlands Bar Association, an organization of black attorneys.

 

Fredrick Franklin's middle name is Douglass; he probably thinks himself a great SJW because of that.

 

The appointment of a special prosecutor became necessary when Douglas County Attorney Don Kleine petitioned for the process. Kleine initially said on June 1 that he would not bring charges and did not think it necessary to have a grand jury review the case.

So the white DA doesn't think there's a crime here

Two days later, Kleine said he had listened to several people, including elected officials who represent predominantly black neighborhood

and had decided to allow a grand jury review in this โ€œrareโ€ instance. He said he is not afraid to have a second set of eyes review his charging decisions. That said, Kleine also said he stands by his decision to not charge Gardner.

In other words, the white DA was pressured by BLM and the crowds of protestors of the Solidarity Rally to convene a Grand Jury, even when he was sure that no crime had been committed.

Douglas County District Court Judge Shelly Stratman then appointed a special council, Fredrick Franklin, an assistant U.S. attorney in the U.S. Attorneyโ€™s Office in Omaha, to handle the case, though they said they expected the same outcome.

Apparently Judge Shelly Stratman didn't trust DA Don Kleine to get the result she wanted (shades of Judge Sullivan).

 

Instead, Franklin bowed to pressure anddug up evidenceand ~~came~~madeup with charges.

The old but true saw - a prosecutor can get a Grand Jury to indict a ham sandwich.

 

As an aside, I don't know whether there's a relation, but a Frederick Franklin Jr was arrested on murder charges in Lake Charles, LA on March 2, 2018.

My experience to a tee as well, though I did have a Karen bank teller, who I've known for 20 years, go off on me, telling me I'd better wear a mask the next time I come in to the bank or she'd refuse me service. I just smiled and thanked her, never went back in there when she was on shift.
