Secret CIA assessment: Putin ‘probably directing’ influence operation to denigrate Biden

Russian President Vladimir Putin and his top aides are “probably directing” a Russian foreign influence operation to interfere in the 2020 presidential election against former vice president Joe Biden, which involves a prominent Ukrainian lawmaker connected to President Trump’s personal lawyer Rudolph W. Giuliani, a top-secret CIA assessment concluded, according to two sources who reviewed it.

On Aug. 31, the CIA published an assessment of Russian efforts to interfere in the November election in an internal, highly classified report called the CIA Worldwide Intelligence Review, the sources said. CIA analysts compiled the assessment with input from the National Security Agency and the FBI, based on several dozen pieces of information gleaned from public, unclassified and classified intelligence sources. The assessment includes details of the CIA’s analysis of the activities of Ukrainian lawmaker Andriy Derkach to disseminate disparaging information about Biden inside the United States through lobbyists, Congress, the media and contacts with figures close to the president.

“We assess that President Vladimir Putin and the senior most Russian officials are aware of and probably directing Russia’s influence operations aimed at denigrating the former U.S. Vice President, supporting the U.S. president and fueling public discord ahead of the U.S. election in November,” the first line of the document says, according to the sources.

The Office of the Director of National Intelligence and the Treasury Department have identified Derkach as a Russian agent, but it has not been publicly reported that the CIA, NSA and FBI believed Putin may be personally directing the campaign. Derkach has denied working on behalf of Moscow.

The CIA assessment described Derkach’s efforts in detail and said that his activities have included working through lobbyists, members of Congress and U.S. media organizations to disseminate and amplify his anti-Biden information. Though it refers to Derkach’s interactions with a “prominent” person connected to the Trump campaign, the analysis does not identify the person. Giuliani, who has been working with Derkach publicly for several months, is not named in the assessment.

The CIA, NSA and FBI all declined to comment, but none of the three agencies disputed any of the details of this reporting. Details about the intelligence used to form the assessment have been withheld at the agencies’ request to protect sources and methods. The White House also declined to comment.

On Sept. 10, following calls from Democratic lawmakers, the Treasury Department sanctioned Derkach, alleging that he “has been an active Russian agent for over a decade, maintaining close connections with the Russian Intelligence Services.” Treasury Secretary Steven Mnuchin said in a Sept. 10 statement that “Derkach and other Russian agents employ manipulation and deceit to attempt to influence elections in the United States and elsewhere around the world.” The Treasury Department stated Derkach “waged a covert influence campaign centered on cultivating false and unsubstantiated narratives concerning U.S. officials in the upcoming 2020 Presidential Election,” which he did by releasing edited audio tapes and other unsupported information that were then pushed in Western media.

On Aug. 7, the Office of the Director of National Intelligence released a statement from National Counterintelligence and Security Center Director William Evanina that named Derkach as part of a Russian effort to “denigrate” Biden by “spreading claims about corruption — including through publicizing leaked phone calls — to undermine former Vice President Biden’s candidacy and the Democratic Party.”

Last week, FBI Director Christopher A. Wray referred to Evanina’s statement in testimony before the House Homeland Security Committee without referring to Derkach by name. Wray said the FBI was tracking “very active efforts” by Russia “to both sow divisiveness and discord, and I think the intelligence community has assessed this publicly, primarily to denigrate Vice President Biden.”

Trump responded to Wray by saying he was bothered the FBI director didn’t talk about China’s interference. ODNI has also reported that China and Iran are attempting to interfere in the U.S. political process. Trump has also personally promoted the anti-Biden information Derkach is peddling. On Aug. 18, Trump retweeted a since-banned Twitter user who posted part of a purported 2016 audio tape Derkach released this year of Biden speaking with then-Ukrainian President Petro Poroshenko.

The tapes Derkach released appear to show Biden linking loan guarantees to the ouster of then-Ukrainian Prosecutor General Viktor Shokin, who was accused of corruption. Giuliani, who met with Derkach in Kiev in December and in New York this year, has claimed the tapes show Biden was working to protect his son Hunter, who at the time was on the board of the Ukrainian gas company Burisma. The released tapes show no such connection.

Giuliani has admitted Derkach provided him materials as part of Giuliani’s quest to prove wrongdoing by the Bidens and his contention that the Ukrainian government interfered in the 2016 presidential election on the side of the Democrats, including by sharing evidence of corruption implicating Trump’s second 2016 campaign chairman, Paul Manafort. Manafort was later convicted of tax and bank fraud related to his Ukraine work. Derkach published some of these materials on a public website he created.

Derkach told Politico in July that he passed along packets of materials to several lawmakers and White House officials. He said he notified Sens. Ron Johnson (R-Wis.), Charles E. Grassley (R-Iowa) and Lindsey O. Graham (R-S.C.) about the material. Johnson, Grassley and Graham have denied they received information from Derkach. Rep. Devin Nunes (R-Calif.) has declined to comment on whether he received materials from Derkach. Democratic leaders wrote to Wray in July to demand a briefing based on concerns that members of Congress were being used to launder information as part of a foreign interference operation.

Johnson has launched an investigation into Biden and Burisma, the results of which could be released as early as this week. The State Department provided Johnson with more than 16,000 pages of information for his investigation months ago, but only shared those documents with Congress on Friday, following a subpoena by House Foreign Affairs Committee Chairman Eliot L. Engel (D-N.Y.).

After meeting with Derkach in December, in the middle of Trump’s impeachment proceedings, Giuliani tweeted that U.S. aid to Ukraine might face a “major obstacle” if the Ukrainian government didn’t resolve his concerns about corruption. Giuliani and Derkach’s allegations against Biden were covered extensively by the One America News Network, which sent a correspondent with Giuliani to Kiev. In February, Giuliani interviewed Derkach on YouTube, where Derkach alleged that U.S. aid to Ukraine was misspent.

Even though Derkach is a former member of a pro-Russian party who attended the Dzerzhinsky Higher School of the KGB in Moscow, Giuliani has consistently defended his relationship with Derkach. Following the Treasury Department’s announcement sanctioning Derkach, Giuliani told the New York Times he had “no reason to believe [Derkach] is a Russian agent,” but added, “How the hell would I know?”

Engel told me he is not surprised to learn that parts of the intelligence community have concluded Putin is directly trying to help Trump’s election campaign, again. But he called on the administration to publicly release these findings.

“What’s most infuriating is that the administration seems to be doing everything it can to hide the facts from Congress and the American people,” he said. “The president seems to be trying to turn the entire executive branch into an arm of his reelection campaign, dangerously politicizing foreign policy and intelligence.”

Statement by NCSC Director William Evanina: Election Threat Update for the American Public

On July 24, 2020, I issued a statement to the American public providing an unclassified overview of foreign threats to the 2020 election and offering basic steps to mitigate some of these threats. At that time, I pledged that the U.S. Intelligence Community (IC) would continue to update the American public and other key stakeholders on the evolving election threat landscape, while also safeguarding our intelligence sources and methods.

Today, we are making good on that promise by sharing additional information with the public on the intentions and activities of our adversaries with respect to the 2020 election. This information is being released for the purpose of better informing Americans so they can play a critical role in safeguarding our election. Below is the latest public update:

Ahead of the 2020 U.S. elections, foreign states will continue to use covert and overt influence measures in their attempts to sway U.S. voters’ preferences and perspectives, shift U.S. policies, increase discord in the United States, and undermine the American people’s confidence in our democratic process. They may also seek to compromise our election infrastructure for a range of possible purposes, such as interfering with the voting process, stealing sensitive data, or calling into question the validity of the election results. However, it would be difficult for our adversaries to interfere with or manipulate voting results at scale.

Many foreign actors have a preference for who wins the election, which they express through a range of overt and private statements; covert influence efforts are rarer. We are primarily concerned about the ongoing and potential activity by China, Russia, and Iran.

CHINA – We assess that China prefers that President Trump – whom Beijing sees as unpredictable – does not win reelection. China has been expanding its influence efforts ahead of November 2020 to shape the policy environment in the United States, pressure political figures it views as opposed to China’s interests, and deflect and counter criticism of China. Although China will continue to weigh the risks and benefits of aggressive action, its public rhetoric over the past few months has grown increasingly critical of the current Administration’s COVID-19 response, closure of China’s Houston Consulate, and actions on other issues. For example, it has harshly criticized the Administration’s statements and actions on Hong Kong, TikTok, the legal status of the South China Sea, and China’s efforts to dominate the 5G market. Beijing recognizes that all of these efforts might affect the presidential race.

RUSSIA – We assess that Russia is using a range of measures to primarily denigrate former Vice President Biden and what it sees as an anti-Russia “establishment.” This is consistent with Moscow’s public criticism of him when he was Vice President for his role in the Obama Administration’s policies on Ukraine and its support for the anti-Putin opposition inside Russia. For example, pro-Russia Ukrainian parliamentarian Andriy Derkach is spreading claims about corruption – including through publicizing leaked phone calls – to undermine former Vice President Biden’s candidacy and the Democratic Party. Some Kremlin-linked actors are also seeking to boost President Trump’s candidacy on social media and Russian television.

IRAN – We assess that Iran seeks to undermine U.S. democratic institutions, President Trump, and to divide the country in advance of the 2020 elections. Iran’s efforts along these lines probably will focus on on-line influence, such as spreading disinformation on social media and recirculating anti-U.S. content. Tehran’s motivation to conduct such activities is, in part, driven by a perception that President Trump’s reelection would result in a continuation of U.S. pressure on Iran in an effort to foment regime change.

Ruth Bader Ginsburg, No Fan of Donald Trump, Critiques Latest Term

WASHINGTON — Unless they have a book to sell, Supreme Court justices rarely give interviews. Even then, they diligently avoid political topics. Justice Ruth Bader Ginsburg takes a different approach.

These days, she is making no secret of what she thinks of a certain presidential candidate.

“I can’t imagine what this place would be , I can’t imagine what the country would be , with Donald Trump as our president,” she said. “For the country, it could be four years. For the court, it could be — I don’t even want to contemplate that.”

It reminded her of something her husband, Martin D. Ginsburg, a prominent tax lawyer who died in 2010, would have said.

“‘Now it’s time for us to move to New Zealand,’” Justice Ginsburg said, smiling ruefully.

In an interview in her chambers on Friday, Justice Ginsburg took stock of a tumultuous term and chastised the Senate for refusing to act on President Obama’s Supreme Court nominee.

Her colleagues have said nothing in public about the presidential campaign or about Mr. Obama’s stalled nomination of Judge Merrick B. Garland to the Supreme Court. But Justice Ginsburg was characteristically forthright, offering an unequivocal endorsement of Judge Garland.

“I think he is about as well qualified as any nominee to this court,” she said. “Super bright and very nice, very easy to deal with. And super prepared. He would be a great colleague.”

Asked if the Senate had an obligation to assess Judge Garland’s qualifications, her answer was immediate.

“That’s their job,” she said. “There’s nothing in the Constitution that says the president stops being president in his last year.”

The court has been short-handed since Justice Antonin Scalia died in February, and Justice Ginsburg said it will probably remain that way through most or all of its next term, which starts in October. Even in “the best case,” in which Judge Garland was confirmed in the lame-duck session of Congress after the presidential election on Nov. 8, she said, he will have missed most of the term’s arguments and so could not vote in those cases.

Justice Ginsburg, 83, said she would not leave her job “as long as I can do it full steam.” But she assessed what is at stake in the presidential election with the precision of an actuary, saying that Justices Anthony M. Kennedy and Stephen G. Breyer are no longer young.

“Kennedy is about to turn 80,” she said. “Breyer is going to turn 78.”

For the time being and under the circumstances, she said, the Supreme Court is doing what it can. She praised Chief Justice John G. Roberts Jr.

“He had a hard job,” Justice Ginsburg said. “I think he did it quite well.”

It was a credit to the eight-member court that it deadlocked only four times, she said, given the ideological divide between its liberal and conservative wings, both with four members.

One of the 4-4 ties, Friedrichs v. California Teachers Association, averted what would have been a severe blow to public unions had Justice Scalia participated. “This court couldn’t have done better than it did,” Justice Ginsburg said of the deadlock. When the case was argued in January, the majority seemed prepared to overrule a 1977 precedent that allowed public unions to charge nonmembers fees to pay for collective bargaining.

A second deadlock, in United States v. Texas, left in place a nationwide injunction blocking Mr. Obama’s plan to spare more than four million unauthorized immigrants from deportation and allow them to work. That was unfortunate, Justice Ginsburg said, but it could have been worse.

“Think what would have happened had Justice Scalia remained with us,” she said. Instead of a single sentence announcing the tie, she suggested, a five-justice majority would have issued a precedent-setting decision dealing a lasting setback to Mr. Obama and the immigrants he had tried to protect.

Justice Ginsburg noted that the case was in an early stage and could return to the Supreme Court. “By the time it gets back here, there will be nine justices,” she said.

She also assessed whether the court might have considered a narrow ruling rejecting the suit, brought by Texas and 25 other states, on the ground that they had not suffered the sort of direct and concrete injury that gave them standing to sue. Some of the chief justice’s writings suggested that he might have found the argument attractive.

“That would have been hard for me,” Justice Ginsburg said, “because I’ve been less rigid than some of my colleagues on questions of standing. There was a good argument to be made, but I would not have bought that argument because of the damage it could do” in other cases.

The big cases the court did decide, on abortion and affirmative action, were triumphs, Justice Ginsburg said. Both turned on Justice Kennedy’s vote. “I think he comes out as the great hero of this term,” Justice Ginsburg said.

The affirmative action case, Fisher v. University of Texas, was decided by just seven justices, 4 to 3. Justice Elena Kagan had recused herself because she had worked on the case as United States solicitor general.

But Justice Ginsburg said the decision was built to last. “If Justice Kagan had been there, it would have been 5 to 3,” she said. “That’s about as solid as you can get.”

“I don’t expect that we’re going to see another affirmative action case,” Justice Ginsburg added, “at least in education.”

The abortion decision, Whole Woman’s Health v. Hellerstedt, in a 5-to-3 vote, struck down two parts of a restrictive Texas law, ones requiring doctors who perform abortions to have admitting privileges at nearby hospitals and abortion clinics to meet the demanding standards of ambulatory surgical centers.

Justice Kennedy had only once before voted to find an abortion restriction unconstitutional, in Planned Parenthood v. Casey in 1992, when he joined Justices Sandra Day O’Connor and David H. Souter to save the core of Roe v. Wade, the 1973 decision that established a constitutional right to abortion.

Asked if she had been pleased and surprised by Justice Kennedy’s vote in the Texas case, Justice Ginsburg responded: “Of course I was pleased, but not entirely surprised. I know abortion cases are very hard for him, but he was part of the troika in Casey.”

Justice Breyer wrote the methodical majority opinion in the Texas case, and Justice Ginsburg added only a brief, sharp concurrence.

“I wanted to highlight the point that it was perverse to portray this as protecting women’s health,” she said of the challenged requirements. “Desperate women then would be driven to unsafe abortions.”

The decision itself, she said, had a message that transcended the particular restrictions before the court.

“It says: ‘No laws that are meant to deny a woman her right to choose,’” she said.

Asked if there were cases she would like to see the court overturn before she leaves it, she named one.

“It won’t happen,” she said. “It would be an impossible dream. But I’d love to see Citizens United overruled.”

She mulled whether the court could revisit its 2013 decision in Shelby County v. Holder, which effectively struck down a key part of the Voting Rights Act. She said she did not see how that could be done.

The court’s 2008 decision in District of Columbia v. Heller, establishing an individual right to own guns, may be another matter, she said.

“I thought Heller was “a very bad decision,” she said, adding that a chance to reconsider it could arise whenever the court considers a challenge to a gun control law.

Should Judge Garland or another Democratic appointee join the court, Justice Ginsburg will find herself in a new position, and the thought seemed to please her.

“It means that I’ll be among five more often than among four,” she said.
