Violent threatening mob outside Mitch M's house, politicians/elites threatening/telling us how they will burn things down if the vacant seat gets filled before the election.

When would it be perfectly acceptable for someone like Mitch, or a threatened regular citizen, to come out of their house and start shooting at an obvious hostile enemy? If a Civil War 2.0 breaks out, assuming it already hasn't… how do we know when it's officially time to start ''winning it without fear'' of the cops throwing us in jail to be prosecuted by da's appointed/funded by enemies?

Exactly. It's maddening how the good guys get charged/arrested/prosecuted/sentenced. It feels like my tax dollars are being wasted on a failed system. How will we know when we are expected/required/allowed to win by any means necessary?
