Fifteen sex offenders in NI to have convictions rescinded due to accidental error in law

 

Fifteen sex offenders in Northern Ireland are to have their convictions rescinded due to an error in drafting updated legislation.

 

Their offences involved 17 victims, 11 of whom were children at the time, and include 15 convictions for indecent assault and two for unlawful carnal knowledge. They took place between 1973 and 2009.

 

The North’s Public Prosecution Service (PPS) announced on Wednesday that prosecutors had become aware of a change in the law in 2009 which had unintentionally removed certain types of sexual offences from the list of cases that could be prosecuted in the Magistrates’ Court. The offences could therefore only be dealt with by the Crown Court.

 

The mistake in drafting the legislation was made before the devolution of justice powers to the Northern Executive in 2010, when justice matters in Northern Ireland remained the responsibility of the UK government.

 

The PPS said it initiated a review of all cases, and had established that between 2009 and 2017, 15 defendants had been prosecuted and convicted in Magistrates’ courts in Northern Ireland despite the court having no power to hear the cases.

Former Solon schools band director arrested for alleged sex crimes involving 12-year-old

 

SOLON, Ohio — The former band director for the Solon City School District has been arrested on accusations of a sexual crime involving a 12-year-old child.

 

Police say Edward Kline is charged with gross sexual imposition, a third-degree felony. The alleged incident occurred back in September of 2010.

 

Kline was taken to the Solon jail and was scheduled to be arraigned in Bedford Municipal Court at 10 a.m. Wednesday. Accusations against him were first reported by the Cleveland Jewish News back in July after multiple female former students came forward on social media and accused Kline of molesting them.

Diversity is about saving Marines' lives, not political correctness, commandant says

 

The Marine Corps needs to become more diverse in order to save Marines’ lives, Corps Commandant Gen. David Berger said on Wednesday.

 

“I am absolutely convinced: Too much similarity – too much that we look all the same, think the same, got the same background – we’re going to get killed because we’re going to end up with solutions that we’re all familiar with but they’re easy to counter,” Berger said during the Marine Corps Association’s annual Modern Day Marine expo.

 

Berger stressed that the Marine Corps will become more capable force as it diversifies on many levels, including diversity of thought, culture, and ethnic backgrounds.

 

Homogenous organizations skew toward groupthink solutions, which can be anticipated and defeated by adversaries, he said.

 

“This is without question scientifically proven: The best organizations are diverse,” Berger said. “They come up with better solutions faster.”

 

“We have to be diverse; in other words, because our warfighting requirement means we have to outthink, outfight an enemy,” he continued. “That’s going to require a more diverse force – not because it’s politically correct.”

House lawmakers unanimously pass bill that would allow Alwyn Cashe to finally receive the Medal of Honor

 

Lawmakers in the House of Representatives unanimously passed legislation that would allow President Donald Trump to upgrade the Silver Star of Army Sgt. 1st Class Alwyn Cashe to the Medal of Honor, solidifying a step forward in the push to recognize Cashe for his heroic actions in 2005.

 

The House bill that passed on Tuesday waives the requirement that a service member receive the Medal of Honor within five years of their bravery so that Cashe's award can be upgraded, Military Times reports; language calling for the Medal of Honor was also included in the national defense authorization act this summer.

 

Rep. Stephanie Murphy, D-Fla., who introduced the legislation that passed on Tuesday, said Cashe is "a hero in the purest and most profound sense," according to Stars and Stripes.

 

"What he did on that Iraq battlefield really takes your breath away," she said.

 

Cashe, 35, was on his second deployment to Iraq in October 2005 when his Bradley Fighting Vehicle hit an improvised explosive device. The explosion soaked Cashe in fuel, according to his Silver Star citation; when the Bradley finally stopped rolling, it "immediately erupted in flames."

 

Despite Cashe being injured from the explosion, and drenched in fuel, he went back to the burning vehicle three times to save other soldiers inside the wreckage.

 

"Without regard for his personal safety, Sergeant First Class Cashe rushed to the back of the vehicle, reaching into the hot flames and started pulling out his soldiers. The flames gripped his fuel soaked uniform," the citation reads. "Flames quickly spread all over his body. Despite the terrible pain, Sergeant First Class Cashe placed the injured soldier on the ground and returned to the burning vehicle to retrieve another burning soldier; all the while, he was still on fire."

 

Cashe saved six soldiers that day, despite 72% of his body being covered in 2nd and 3rd degree burns. He died on Nov. 8, 2005, at Brooke Army Medical Center in San Antonio.

 

In August, Defense Secretary Mark Esper threw his support behind the effort to upgrade Cashe's Silver Star, telling lawmakers in a letter that he believed “SFC Cashe’s actions merit award of the Medal of Honor.”
