None of that will matter much if Biden is elected because it will all be memory-holed. I'm not entirely confident that it will matter much even if Trump is re-elected, as there seems to be no urgency behind prosecuting anything.
I take the "less than 1%" to mean that the illegal political spying constitutes less than 1% of the crimes which will be charged, on other words, the least of their worries.
