suspension of the writ has a long history

in england the monarch exercised this power and the parliment fought back

when our consitution was drafted the executive power to suspend habeus was NOT restricted BUT congress power to do so WAS restrcited to times of emergency

the mainstream narrative is this applies to the POTUS (this is one reason I detest ACB) but it does NOT -

the SCOTUS has declared it has (some indirect) power to review denial of habeus by POTUS - ie to review if the determination of "enemy combatant" status was correct or not

 

other than that POTUS power to suspend habeus is unrestricted
